NOTICE OF HEARING
APPLICATION NO. 1310027
CHIGWELL FIELD
SPECIAL GAS WELL SPACING – EDMONTON GROUP COALS
FAIRBORNE ENERGY LTD.

Take Notice that Examiners appointed by the Alberta Energy and Utilities Board (EUB) will hold a public hearing of Application No. 1310027 at the GreenWay Inn, 5401 HWY 2A, Lacombe, Alberta commencing on Monday, May 17, 2004 at the hour of 9:00 a.m. All interveners to this proceeding must be present at the commencement of the hearing to register their appearance.

Nature of the Application
Fairborne Energy Ltd. (Fairborne) has applied pursuant to Section 79, Subsection 4 of the Oil and Gas Conservation Act and Section 5.190 of the Oil and Gas Conservation Regulations for the suspension of the drilling spacing units and target area provisions and to establish separate holdings in Sections 12 and 14 of Township 41, Range 24, West of the 4th Meridian. Fairborne proposes that a well drilled in the holdings for the production of gas from the Edmonton Group coals be subject to the following provisions:

  1. A minimum distance of 200 metres shall be maintained between wells producing from the same pool.

  2. A minimum distance of 200 metres shall be maintained between a producing well and the boundaries of the holdings.

Any person intending to make a submission with respect to the hearing of Application No. 1310027 shall file on or before Friday, May 7, 2004. Send one copy of your submission, in writing, to the applicant at the name and address listed above and fifteen copies of the submission to:

Notes

Any submission filed shall contain information detailing:

(i)  the desired disposition of the application;

(ii) the facts substantiating the position of the submitter;

(iii) the reasons why the submitter believes the Board should decide in the manner advocated, and

(iv) how the proposed project, if approved, may directly and adversely affect the submitter.

In accordance with Section 38 of the Alberta Energy and Utilities Board Rules of Practice, all witnesses must give evidence under oath or affirmation.

If there are no valid objections received, this hearing may be cancelled and the EUB will proceed with the disposition of the application without further notice and/or without a hearing.

Submissions relating exclusively to compensation for land usage are not dealt with by the EUB, but may be referred to the Alberta Surface Rights Board.
