NOTICE OF HEARING

APPLICATION NO. 1325847

FORT MCMURRAY AREA

SUNCOR ENERGY INC.

SOUTH TAILINGS POND PROJECT

Take notice that the Alberta Energy and Utilities Board (EUB) will hold a public hearing of Application No. 1325847 at the C.A. Knight Recreation Facility, MacDonald Island Park, 151 MacDonald Drive, Fort McMurray, Alberta commencing on Tuesday, October 26, 2004 at the hour of 9:00 a.m. All interveners to this proceeding must be present at the commencement of the hearing to register their appearance.

Nature of the Application

Suncor Energy Inc. (Suncor) has applied pursuant to Section 13 of the Oil Sands Conservation Act to amend approval No. 8535 to construct, operate and reclaim an external tailings pond (South Tailings Pond Project). The proposed South Tailings Pond Project is to be located to the southeast of the existing Millennium Mine and will be situated primarily in the southern half of Township 91, Ranges 8 and 9, and partly in the northern portion of Township 90, Range 9, West of the 4th Meridian. The South Tailings Pond Project development footprint equals 2,355 ha and is designed with a maximum storage capacity of 350 million cubic metres. The South Tailings Pond Project would supply extra storage capacity for the continued operation of the current mining and extraction facilities.

In support of its proposal and as part of the application to the EUB, Suncor has also prepared and submitted an Environmental Impact Assessment (EIA) report to the Director, Environmental Assessment, Northern Region.

Any person intending to make a submission with respect to the hearing of Application No. 1325847 shall file on or before October 13, 2004. Send one copy of your submission, in writing, to the applicant at the name and address listed above and fifteen copies of the submission to

Notes

Any submission filed shall contain information detailing:

i)  the desired disposition of the application,

ii) the facts substantiating the position of the submitter,

iii) the reasons why the submitter believes the EUB should decide in the manner advocated, and

iv) how the proposed project, if approved, may directly and adversely affect the submitter.

If there are no valid objections received, this hearing may be cancelled and the EUB will proceed with the disposition of the application without further notice and/or without a hearing.

In accordance with Section 38 of the Alberta Energy and Utilities Board Rules of Practice, all witnesses must give evidence under oath or affirmation. In accordance with Section 12 of the Alberta Energy and Utilities Board Rules of Practice, all documents filed in respect of this proceeding must be placed on the public record unless otherwise ordered by the Board.
