NOTICE OF HEARING
APPLICATION NO. 1454561
WAVE ENERGY LTD.
BERWYN FIELD

Take Notice that the Alberta Energy and Utilities Board (EUB/Board) will hold a public hearing of Application No.1454561 at the offices of the EUB, 640 – 5 Avenue SW, Calgary, Alberta, commencing on Tuesday, October 10, 2006, at the hour of 1:30 p.m. All interveners to this proceeding must be present at the commencement of the hearing to register their appearance.

Nature of the Application
Wave Energy Ltd. applied

• under section 48 (1) of the Oil and Gas Conservation Act (OGCA) for an order declaring Adamant Energy Inc. (Adamant) as a common carrier of gas from the well in Legal Subdivision 5 of Section 2, Township 82, Range 24, West of the 5th Meridian (LSD 5-2-82-24 W5M) (the 5-2 well) and such other wells that may be drilled into Berwyn Bluesky undefined pool, through a pipeline extending from LSD 5-2-82-24 W5M (the 5-2 tie in) to the Adamant gas plant located at LSD 8-36-82-26 W5M (the Adamant gas plant);

• under Section 53 (1) of the OGCA for an order declaring Adamant as a common processor of gas from the 5-2 well and such other wells that may be drilled into the Berwyn Bluesky Undefined Pool through the Adamant gas plant;

• under Section 48 (4)(a) of the OGCA for the EUB to designate the 5-2 tie in location as the point at which the common carrier shall take delivery of the gas to be transported under common carrier order;

• under Sections 55 (2) and 55 (3) of the OGCA for the EUB to set the transportation and processing fees for the gas subject to common carrier and common processor orders; and

• under Section 56 of the OGCA for the above noted orders to be as of the date of the 5-2 well  brought on production, December 5, 2005.

The Board has established the following filing deadlines for this hearing:

September 18, 2006               Final date for submissions by any parties having concerns
                                               respecting the application.

October 2, 2006                     Final date for any response from the applicant to the submissions
                                               filed by concerned parties.

Notes
Any submission filed shall contain the following:

(a) a concise statement indicating

(i) the manner in which the intervener’s rights may be directly and adversely affected by a decision of the Board on the proceeding,

(ii) the nature and scope of the intervener’s intended participation,

(iii) the disposition of the proceeding that the intervener advocates, if any,

(iv) the facts the intervener proposes to show in evidence,

(v) the reasons why the intervener believes the Board should decide in the manner that the intervener advocates, and

(vi) the intervener’s efforts, if any, to resolve issues associated with the proceeding directly with the applicant;

(b) the name, address in Alberta, telephone number, fax number and, if available, e-mail address of the intervener;

(c) if the intervener is represented by a representative, the name, address in Alberta, telephone number, fax number and, if available, e-mail address of the representative;

(d) if the intervener is an unincorporated organization, the nature of the intervener’s membership.

If you have an interest in this matter, you are required to make a submission with respect to this application even if you have previously filed a submission with the EUB or with the applicant.

If there are no submissions received, this hearing may be cancelled and the EUB will continue to process the application without further notice or without a hearing.

In accordance with Section 38 of the Alberta Energy and Utilities Board Rules of Practice, witnesses must give evidence under oath or affirmation.

In accordance with Section 23.1 of the Alberta Energy and Utilities Board Rules of Practice, a person who intends to raise a question of constitutional law before the Board must give notice in accordance with Section 12 of the Administrative Procedures and Jurisdiction Act and its regulation.

Submissions relating exclusively to compensation for land usage are not dealt with by the EUB, but may be referred to the Alberta Surface Rights Board. 
 
Any statements filed regarding this application become part of the public record and are accessible by the public.
