NOTICE OF HEARING
APPLICATION NO. 1523329
NEXXTEP RESOURCES LTD.
WILSON CREEK FIELD
LOWER MANNVILLE C POOL

Take Notice that the Energy Resources Conservation Board (ERCB/Board) will hold a public hearing of Application No. 1523329 at the ERCB’s offices, 640 - 5 Avenue S.W., Calgary, Alberta, commencing on Monday, December 1, 2008, at the hour of 1:00 p.m. All interveners to this proceeding must be present at the commencement of the hearing to register their appearance.

Nature of the Application
Application No. 1523329 by Nexxtep Resources Ltd. (Nexxtep) would be to redesignate the Wilson Lower Mannville C pool (0973 031003 000) to a Rock Creek pool. The application is made pursuant to Section 33(1) (d) of the Oil and Gas Conservation Act (OGCA). Consequential measures, in accordance with Sections 16 and 25 of the OGCA and such other or alternative relief as the ERCB may deem appropriate, are also requested.

Schedule for Filing Submissions
The Board has established the following filing deadlines for this hearing:

September 4, 2008 - Information requests to Nexxtep
September 22, 2008 - Response by Nexxtep to information requests
October 6, 2008 - Submissions by interveners
October 20, 2008 - Information requests to interveners
November 3, 2008 - Responses by interveners to information requests
November 17, 2008 - Reply evidence by Nexxtep

Interveners should send their information requests to the applicant, with a copy to the ERCB, at the above addresses. Interveners should send one copy of their submissions and responses to information requests to the applicant and any other interveners, and one electronic copy of the materials on CD in PDF format and fifteen paper copies to the ERCB.

The applicant should send one copy of its response to information requests and reply submission to any interveners and interested parties who have filed information requests and/or submissions, and one electronic copy on CD in PDF format and fifteen paper copies to the ERCB. The applicant should send its information requests to any interveners who have filed submissions, with a copy to the ERCB.

Notes
Any submissions filed by interveners shall contain the following:

(a) a concise statement indicating

(i) the manner in which the intervener’s rights may be directly and adversely affected by a decision of the Board on the proceeding,

(ii) the nature and scope of the intervener’s intended participation,

(iii) the disposition of the proceeding that the intervener advocates, if any,

(iv) the facts the intervener proposes to show in evidence,

(v) the reasons why the intervener believes the Board should decide in the manner that the intervener advocates, and

(vi) the intervener’s efforts, if any, to resolve issues associated with the proceeding directly with the applicant;

(b) the name, address in Alberta, telephone number, fax number and, if available, e-mail address of the intervener;

(c) if the intervener is represented by a representative, the name, address in Alberta, telephone number, fax number and, if available, e-mail address of the representative; and

(d) if the intervener is an unincorporated organization, the nature of the intervener’s membership.

If you have an interest in this matter, you are required to make a submission with respect to this application even if you have previously filed a submission with the Board or with Nexxtep on this application.

Submissions relating exclusively to compensation for land usage are not dealt with by the ERCB but may be referred to the Alberta Surface Rights Board.

In accordance with Section 13 of the Energy Resources Conservation Board Rules of Practice, all documents filed in respect of this proceeding must be placed on the public record. However, any party may make an application to the Board for confidentiality pursuant to Section 13(2) and serve a copy of such request on the other parties involved in the hearing. The Board may grant a request for confidentiality on any terms it considers appropriate, subject to the Freedom of Information and Protection of Privacy Act.

In accordance with Section 25 of the Energy Resources Conservation Board Rules of Practice, a person who intends to raise a question of constitutional law before the Board must give notice in accordance with Section 12 of the Administrative Procedures and Jurisdiction Act and its regulation.

In accordance with Section 40 of the Energy Resources Conservation Board Rules of Practice, witnesses must give evidence under oath or affirmation.
