The Energy Resources Conservation Board (ERCB/Board) has received Application No. 1641149 and Alberta Environment (AENV) has received Environmental Protection and Enhancement Act (EPEA) Application No. 015-46972 and a Water Act application. This notice is being distributed to advise interested persons that the applications are available and that the ERCB, AENV, and other government departments are now undertaking a review of the applications.
The proposed development would include a new pit licence and two new external dump licences to develop the McLeod-Harris pits and external dumps. The proposed development would connect to the existing haul road for coal delivery to the coal preparation plant and rail loadout at the Luscar Mine Site. The proposed development would be located in the Mountain Park area, about 70 kilometres (km) south of Hinton and 12 km south of the Hamlet of Cadomin in Townships 45 and 46, Range 23, West of the 5th Meridian, within Yellowhead County. The proposed development would have the potential to produce about 3.3 million tonnes of raw coal per year over a six year period.
Nature of the Applications
- Cardinal River Coals Ltd. (CRC) has applied, pursuant to Section 11(a) of the Coal Conservation Act and Sections 8(1) and 8(3) of the Coal Conservation Regulations, for the development, operation, and reclamation of the McLeod-Harris pit and external dump licences.
- CRC has applied to AENV, pursuant to Section 72 of the EPEA, for an amendment to existing Approval No. 46972 to allow for the opening up, operation, and reclamation of the McLeod-Harris pit and associated dumps. The proposed pit and dumps would require about 529.6 hectares (ha) of disturbance. Soil material would be conserved for reclamation. The disturbed areas would be reclaimed to open forest, shrub and grasslands, wildlife habitat and riparian features, including one end-pit lake about 54 ha in size.
- CRC has submitted an application (File No. 00205213) to AENV, pursuant to Section 109 of the Water Act, to divert Harris Creek and associated tributaries; pit dewatering and groundwater diversion; construction and operation of a temporary and permanent sedimentation facilities; construction of a culverted crossing of the upper McLeod River; construction of one rock drain for Harris Creek; and creation of one end-pit lake in Harris and elimination of one end-pit lake in Cheviot Creek pit phase 3.

To File a Statement of Concern
Under Section 73 of the EPEA and Section 109 of the Water Act, any person who may be directly affected by the EPEA application or the Water Act application may submit a written statement of concern. Statements of concern under the EPEA and Water Act must be submitted by April 22, 2010. Failure to file a statement of concern may affect the right to file a Notice of Appeal with the Environmental Appeal Board. Please quote Application No. 015-46972 (EPEA) or File No. 00205213 (Water Act) when submitting a statement of concern.
