NOTICE OF HEARING
SECTION 39 REVIEW UNDER THE ENERGY RESOURCES CONSERVATION ACT

APPLICATION NO. 1254348 FOR A SOUR GAS/OIL BATTERY

Take Notice that the Alberta Energy and Utilities Board (EUB/Board) will hold a public hearing at the Nanton Community Hall, 2204 - 18 Street, Nanton, Alberta, commencing at 9:00 a.m. on April 16, 2002, to review Well Licence No. 0242814 of Application No. 1068115 and consider Application No. 1254358 for a sour gas/oil facility. All interveners to this proceeding must be present at the commencement of the hearing to register their appearance.
Nature of the Applications

In accordance with Section 2.020 of the Oil and Gas Conservation Regulations, Conoco Canada Resources Limited (Conoco), formerly Crestar Energy Inc., applied on June 22, 2000, for a licence to drill a level-1 noncritical directional sour gas well with a hydrogen sulphide (H2S) content of 6 moles per kilomole (mol/kmol) (0.6 per cent). The sour gas well would be drilled from a surface location at Legal Subdivision (LSD) 13 of Section 12, Township 17, Range 25, West of the 4th Meridian to a bottomhole location in LSD 9-11-17-25 W4M (9-11 well). The application was approved on October 5, 2000. Upon completing the drilling of the 9-11 well, Conoco determined from well logs that there may be potential for the well to be a sour oil well with an H2S content of 6 mol/kmol (0.6 per cent). Area landowners submitted a request on October 2, 2001, for a review of the Board's decision to issue the well licence. On December 21, 2001, the Board granted the request for a review. The 9-11 well has been shut in and temporarily suspended and has not been completed or tested.

Subsequent to the Board setting the above Section 39 review down for hearing, Conoco applied on January 18, 2002, for a single-well battery in accordance with Section 7.001 of the Oil and Gas Conservation Regulations. The battery would be located in LSD 13-12-17-25 W4M with an H2S content of 9 mol/kmol (0.9 per cent). Since Conoco has not completed or tested the 9-11 well, it indicated that it is uncertain if the well would be a gas well or an oil well. Therefore, Conoco has applied for both a sour gas battery and a sour oil battery to be considered simultaneously.

Conoco and any persons intending to file a submission or written evidence with respect to the hearing of the subject Conoco well and battery applications must file their submissions or written evidence on or before April 2, 2002. Send one copy of the submission or written evidence to the other parties and ten copies to the attention of:

Notes
Any submission or written evidence filed must contain information detailing
(i) the desired disposition of the applications;
(ii) the facts substantiating the position of the submitter; and
(iii) the reasons why the submitter believes the Board should decide in the manner advocated.
In accordance with Section 38 of the EUB Rules of Practice, all witnesses must give evidence under oath or affirmation.
If there are no submissions received, this hearing may be cancelled and the EUB will proceed with the disposition of the applications without further notice.
Submissions relating exclusively to compensation for land usage are not dealt with by the EUB but may be referred to the Alberta Surface Rights board.
