NOTICE OF RESCHEDULING OF HEARING
APPLICATION NO'S. 1345690, 1362181 and 1377394
BEARSPAW PETROLEUM LTD.
FENN-BIG VALLEY/STETTLER FIELDS

Take Notice that the Alberta Energy and Utilities Board (EUB) had scheduled a public hearing of Application Nos. 1345690 and 1362181 in the Multipurpose Room at the Stettler Recreation Centre, 2nd floor, 6202 44th Avenue, Stettler, Alberta, commencing on Thursday, December 16, 2004 at the hour of 10:00 a.m. The Board received a request from interested parties to reschedule the hearing and it agreed to grant the request.

Bearspaw Petroleum Ltd. (Bearspaw) submitted a third application on December 22, 2004 (Application No. 1377394) which they will put forward in place of Application Nos. 1345690 and 1362181 at the hearing. The majority of the project is unchanged, however, the pipeline segment described in Application No. 1345690 terminates at 4-33-37-20W4M whereas the route in Application No. 1377394 is proposed slightly to the west, terminating in 1-32-37-20W4M. As a result of the of the slight routing change, the northern portion of the project which is represented in Application 1362181 will no longer be required.

Therefore, Take Notice that the EUB will hold a public hearing of Application Nos. 1345690, 1362181 and 1377394 in the Multipurpose Room at the Stettler Recreation Centre, 2nd floor, 6202 44th Avenue, Stettler, Alberta, commencing on Monday, January 17, 2005 at the hour of 10:00 a.m. All interveners to this proceeding must be present at the commencement of the hearing to register their appearance.

Nature of Application 1345690

Bearspaw submitted an application in accordance with Part 4 of the Pipeline Act for approval for two pipelines from a pipeline tie in point at Legal Subdivision (LSD) 3, Section 10, Township 37, Range 20, West of the 4th Meridian to a pipeline tie in point at LSD 4-33-37-20W4M. The first proposed pipeline would be approximately 8.05 kilometres (km) in length with a maximum outside diameter of 114.3 millimetres (mm) and would transport natural gas with a maximum hydrogen sulphide (H2S) concentration of 50 moles per kilomole (5.0 per cent). The proposed pipeline would operate as a level 1 pipeline. The second proposed pipeline would be approximately 8.05 km in length with a maximum outside diameter of 88.9 mm and would transport natural gas with no H2S content.

Nature of Application 1362181

Bearspaw submitted an application in accordance with Part 4 of the Pipeline Act for approval to construct and operate a pipeline from a pipeline tie-in point at LSD 4-33-37-20W4M to a pipeline tie in point at LSD 2-16-38-20W4M. The proposed pipeline would be approximately 5.17 km in length with a maximum outside diameter of 114.3 mm, and would transport natural gas with an H2S concentration of 50 mol/kmol (5.0 per cent). The proposed pipeline would be operated as a level 1 pipeline.

Nature of Application 1377394

Bearspaw submitted an application in accordance with Part 4 of the Pipeline Act for approval for two pipelines from a pipeline tie in point at Legal Subdivision (LSD) 3, Section 10, Township 37, Range 20, West of the 4th Meridian, to a pipeline tie in point at LSD 1-32-37-20W4M. Any person intending to make a submission with respect to the hearing of Application Nos. 1345690, 1362181 and 1377394 shall file on or before 4:00 p.m., Monday, January 10, 2005. Send one copy of your submission to the applicant at the name and address above and eleven copies to:

Notes

Any submission filed shall contain the following:

(a) a concise statement indicating

(i) the manner in which the intervener's rights may be directly and adversely affected by a decision of the Board on the proceeding,

(ii) the nature and scope of the intervener's intended participation,

(iii) the disposition of the proceeding that the intervener advocates, if any,

(iv) the facts the intervener proposes to show in evidence,

(v) the reasons why the intervener believes the Board should decide in the manner that the intervener advocates, and

(vi) the intervener's efforts, if any, to resolve issues associated with the proceeding directly with the applicant;

(b) the name, address in Alberta, telephone number, fax number and, if available, e-mail address of the intervener;

(c) if the intervener is represented by a representative, the name, address in Alberta, telephone number, fax number and, if available, e-mail address of the representative;

(d) if the intervener is an unincorporated organization, the nature of the intervener's membership.

If you have an interest in this matter, you are required to make a submission with respect to this application even if you have previously filed a submission with the Board or with Bearspaw on this application.

If there are no submissions received, this hearing may be cancelled and the EUB will continue to process the applications without further notice or without a hearing.

In accordance with Section 38 of the Alberta Energy and Utilities Board Rules of Practice, witnesses must give evidence under oath or affirmation.

Submissions relating exclusively to compensation for land usage are not dealt with by the EUB but may be referred to the Alberta Surface Rights Board.
