NOTICE OF RESCHEDULING OF HEARING
APPLICATION NO. 1552791

KNOPCIK FIELD

Take Notice that examiners appointed by the Energy Resources Conservation Board (ERCB/Board) had scheduled a public hearing of Application No. 1552791 at the offices of the Board, 640 - 5 Avenue S.W., Calgary, Alberta, commencing on Monday, July 14, 2008, at the hour of 9:00 a.m. The Board has received a request from interested parties to reschedule the hearing and it has agreed to grant the request.

Therefore, Take Notice that examiners appointed by the ERCB will hold a public hearing of Application No. 1552791 at the offices of the Board, 640 - 5 Avenue S.W., Calgary, Alberta, commencing on Tuesday, September 23, 2008, at the hour of 9:00 a.m. All interveners to this proceeding must be present at the commencement of the hearing to register their appearance.

Nature of the Application
Tykewest Limited has submitted an application, pursuant to

  • Section 48(1) of the Oil and Gas Conservation Act (OGCA) for an order declaring New North Resources Limited as a common carrier of gas from the Knopcik Halfway JJ pool, through a pipeline extending from Legal Subdivision 3 of Section 16, Township 74, Range 11, West of the 6th Meridian (LSD 3-16-74-11W6M) (the 3-16 tie-in) to LSD 13-15-74-11W6M, including a hydrogen sulphide analyzer and fuel gas blending facility at LSD 13-15-74-11W6M;
  • Section 48(4)(a) of the OGCA for the ERCB to designate the 3-16 tie-in location as the point at which the common carrier would take delivery of the gas to be transported under the common carrier order;
  • Section 48(4)(b) of the OGCA for the ERCB to direct the proportion of production to be taken by the common carrier from each producer or owner in the subject pool; and
  • Section 56 of the OGCA for the above noted order to be effective as of the date of the application, December 24, 2007.

August 15, 2008 Final date for any response from the applicant to the submissions filed by concerned parties.

Notes
Any submission filed must contain the following:

(a) a concise statement indicating

(i) the manner in which the intervener’s rights may be directly and adversely affected by a decision of the Board on the proceeding,

(ii) the nature and scope of the intervener’s intended participation,

(iii) the disposition of the proceeding that the intervener advocates, if any,

(iv) the facts the intervener proposes to show in evidence,

(v) the reasons why the intervener believes the Board should decide in the manner that the intervener advocates, and

(vi) the intervener’s efforts, if any, to resolve issues associated with the proceeding directly with the applicant;

(b) the name, address in Alberta, telephone number, fax number and, if available, e-mail address of the intervener;

(c) if the intervener is represented by a representative, the name, address in Alberta, telephone number, fax number and, if available, e-mail address of the representative;

(d) if the intervener is an unincorporated organization, the nature of the intervener’s membership.

If you have an interest in this matter, you are required to make a submission with respect to this application even if you have previously filed a submission with the Board or with Tykewest Limited on this application.

If there are no submissions received, this hearing may be cancelled and the ERCB will continue to process the application without further notice or without a hearing.

In accordance with Section 13 of the Energy Resources Conservation Board Rules of Practice, all documents filed in respect of this proceeding must be placed on the public record. However, any party may make an application to the Board for confidentiality, pursuant to Section 13(2), and serve a copy of such request on the other parties involved in the hearing. The Board may grant a request for confidentiality on any terms it considers appropriate, subject to the Freedom of Information and Protection of Privacy Act.

In accordance with Section 40 of the Energy Resources Conservation Board Rules of Practice, witnesses must give evidence under oath or affirmation.
