NOTICE OF REVIEW HEARING
REVIEW PROCEEDINGS NO. 1634570, 1634572, 1634573, 1634574, 1634576, 1634580, 1634581, 1634583, AND 1634584

ENSIGN, VULCAN, AND PARKLAND NORTHEAST FIELDS

The Energy Resources Conservation Board (ERCB/Board) will hold a public hearing of Proceedings No. 1634570, 1634572, 1634573, 1634574, 1634576, 1634580, 1634581, 1634583, and 1634584 (Proceedings) at the Highwood Memorial Centre, 128 – 5th Avenue, High River, Alberta, commencing on September 21, 2010, at 9:00 a.m. All interveners to the Proceedings must be present at the commencement of the hearing to register their appearance.

Description of the Review Proceedings  

Apache Canada Ltd.
Proceeding No. 1634570
Apache Canada Ltd. (Apache) received approval for Application No. 1468621 to drill a well at Legal Subdivision (LSD) 11, of Section 13, Township 16, Range 26, West of the 4th Meridian, and was issued Licence No. 0361969 in accordance with Section 2.020 of the Oil and Gas Conservation Regulations (OGCR). The purpose of the well is to produce gas with no hydrogen sulphide (H 2 S) from the Sunburst Sands Formation.

Compton Petroleum Corporation
Proceedings No. 1634572 and 1634573
Compton Petroleum Corporation (Compton) is the licensee under Well Licences No. 0364810 (Proceeding No. 1634572) and 0630212 (Proceeding No. 1634573) and Facility Licence No. 36735 (Proceeding No. 1634573), originally issued to a predecessor licensee, in accordance with Section 2.020 of the OGCR, and subsequently transferred to Compton. Licence No. 0364810 was issued to drill a well at LSD 12-9-16-25W4M to produce gas from the Sunburst Sands Formation. Licence No. 0360212 was issued to drill a well at LSD 11-30-15-25W4M to produce crude oil from the Sunburst Sands Formation. Facility Licence No. 36735 was issued for an associated multiwell battery at LSD 9-29-15-25W4M. There is no H 2 S associated with these wells and this facility.

Proceeding No. 1634574
Compton submitted Application No. 1502725, in accordance with Section 2.020 of the OGCR, to drill a well at LSD 6-12-16-25W4M through the Manville and Upper Manville Formations, in which there is the potential to encounter H 2 S. Compton was issued Well Licence No. 0374329 to produce gas from the Sunburst Sands Formation. There is no H 2 S associated with production of this well.

Proceedings No. 1634576 and 1634580
Compton submitted Application No. 1516932 (Proceeding No. 1634576) and Application No. 1493757 (Proceeding No. 1634580), in accordance with Section 2.020 of the OGCR, for licences for two wells. Compton was issued Licence No. 0378837 for a well at LSD 5-4-17-25W4M and Licence No. 0375593 for a well at LSD 14-24-16-24W4M, both for the production of gas from the Belly River Formation. Compton also submitted Application No. 1493722 (Proceeding No. 1634580) for licence for a 1.67 kilometre pipeline at LSD 14-24-16-24W4M, pursuant to Part 4 of the Pipeline Act, and was issued Pipeline Licence No. 46320. There is no H 2 S associated with these facilities.

Darian Resources Ltd.
Proceeding No. 1634581
Darian Resources Ltd. (Darian) is the licensee under Pipeline Licence No. 46187, originally issued to a predecessor licensee through App lication No. 1462770, pursuant to Part 4 of the Pipeline Act. The pipeline is 1.03 kilometres in length, has no associated H 2 S, and is approved to transport natural gas from LSD 2-29-16-25W4M.

Proceeding No. 1634583
Darian is the licensee under Well Licence No. 0387460, originally issued to a predecessor licensee through Application No. 1521086, in accordance with Section 2.020 of the OGCR. The licence is for a well at LSD 16-36-15-26W4M to produce gas from the Sunburst Sands, Glauconitic Sandstone, and Judith River Formations. There is no H 2 S associated with this well.

Proceeding No. 1634584
Darian submitted Application No. 1598300 and was issued Licence No. 0410256 for approval to drill a crude oil well at a surface location of LSD 2-29-15-25W4M. Production is from the Sunburst Sands Formation. This licence was subsequently amended to change the terminating formation of the well to the Rierdon Formation. There is no H 2 S associated with this well.

Nature of the Proceedings
Barbara Graff, Larry Graff, and Darrell Graff (the Graffs) have been granted a review hearing of the applications for the above licences held by Apache, Compton, and Darian, pursuant to Sections 39 and 40 of the Energy Resources Conservation Act. The Board found that the Graffs had provided new information that was not available to or considered by the Board at the time it made its original decisions to approve the wells, pipelines, and facilities, and that the new information may lead the Board to materially vary or rescind its original approval. This is an omnibus review hearing that will consider each of the review proceedings described in this notice.

Requirement to File a Submission
If you have an interest in this matter and wish to make submissions or submit evidence at the hearing of the Proceedings, you must file submissions with respect to these Proceedings even if you have previously filed a submission with the Board. Submissions must include photocopies of all documentary evidence that you intend to present and/or rely on at the hearing (including, but not limited to, copies of expert reports) and a summary of all evidence you intend to present.

How to File a Submission
Additional submissions from the Graffs, Apache, Compton, and Darian with respect to the hearing of the Proceedings must be filed by 4:00 p.m., on or before the filing dates below.

Contents of a Submission
Under Section 24(2) of the Energy Resources Conservation Board Rules of Practice ( Rules of Practice ), submissions must contain the following:

(a) a concise statement indicating

(i) the manner in which the intervener's rights may be directly and adversely affected by a decision of the Board on the proceeding,

(ii) the nature and scope of the intervener's intended participation,

(iii) the disposition of the proceeding that the intervener advocates, if any,

(iv) the facts the intervener proposes to show in evidence,

(v) the reasons why the intervener believes the Board should decide in the manner that the intervener advocates, and

(vi) the intervener's efforts, if any, to resolve issues associated with the proceeding directly with the applicant;

(b) the name, address in Alberta, telephone number, fax number and, if available, e-mail address of the intervener;

(c) if the intervener is represented by a representative, the name, address in Alberta, telephone number, fax number and, if available, e-mail address of the representative; and

(d) if the intervener is an unincorporated organization, the nature of the intervener's membership.

Compensation Issues
Submissions relating exclusively to compensation for land usage are not dealt with by the ERCB and should be referred to the Alberta Surface Rights Board.

Applications for Confidentiality
In accordance with Section 13 of the Rules of Practice, all documents filed in respect of these Proceedings must be placed on the public record. However, any party may apply for confidentiality of information under Section 13(2). Any application under Section 13(2) that is to be considered during a public hearing of the Proceedings must be copied to the other parties to the Proceedings. The Board may grant a request for confidentiality on any terms it considers appropriate, subject to the Freedom of Information and Protection of Privacy Act.

Questions of Constitutional Law
Under Section 25 of the Rules of Practice, a person who intends to raise a question of constitutional law before the Board must give notice in accordance with Section 12 of the Administrative Procedures and Jurisdiction Act and its regulation.
