NOTICE OF BOARD INITIATED REVIEW HEARING
REGARDING DECISION 2007-061
PROCEEDING NO. 1545126

Take Notice that the Alberta Energy and Utilities Board (EUB/Board) will hold a public hearing of Proceeding No. 1545126 at the Causeway Bay Westwinds, 4225 – 50 Street, Drayton Valley, Alberta, commencing on Tuesday December 18, 2007 at the hour of 10:00 a.m. All interveners to this proceeding must be present at the commencement of the hearing to register their appearance.

Nature of the Proceeding
The EUB held a public hearing that resulted in Decision 2007-061. During the hearing, evidence and argument were given that detailed a specific route for a road that West Energy Ltd. (West) committed to construct to address concerns regarding egress in the event of an emergency. On September 24, 2007, Behr Energy Services Ltd., on behalf of West, submitted a letter to the EUB proposing a different route than the one described in the hearing and referred to in Decision 2007-061. Parties to the hearing that resulted in Decision 2007-061 expressed concerns with the proposed alternate routing.

Under Section 39 of the Energy Resources Conservation Act the Board may review, rescind, change, alter or vary an order or direction made by it. Given the change in circumstance with regard to the routing of the egress road, the Board has initiated a proceeding to consider the proposed alternate route.

Schedule
The following is the schedule for the review hearing::
November 23, 2007 - Submission Deadline for West
December 7, 2007 - Submission Deadline for Interveners
December 14, 2007 - Submission Deadline for West’s Reply
December 18, 2007 - Commencement of Hearing

Please note that submissions must include correspondence between the intervener, West, and the EUB related specifically to the routing of the proposed egress road. Submissions should also include a discussion of the new road and its impacts, as well as any access considerations associated with the proposed new routing.

Notes
Any submission filed shall contain the following:

(a) a concise statement indicating

(i) the manner in which the intervener’s rights may be directly and adversely affected by a decision of the Board on the proceeding,

(ii) the nature and scope of the intervener’s intended participation,

(iii) the disposition of the proceeding that the intervener advocates, if any,

(iv) the facts the intervener proposes to show in evidence,

(v) the reasons why the intervener believes the Board should decide in the manner that the intervener advocates, and

(vi) the intervener’s efforts, if any, to resolve issues associated with the proceeding directly with the applicant;

(b) the name, address in Alberta, telephone number, fax number and, if available, e-mail address of the intervener;

(c) if the intervener is represented by a representative, the name, address in Alberta, telephone number, fax number and, if available, e-mail address of the representative; and

(d) if the intervener is an unincorporated organization, the nature of the intervener’s membership.

If you have an interest in this matter, you are required to make a submission with respect to this proceeding even if you have previously filed a submission with the Board or with West.

If there are no submissions received, this proceeding may be cancelled.

Submissions relating exclusively to compensation for land usage are not dealt with by the EUB but may be referred to the Alberta Surface Rights Board.

In accordance with Section 12 of the Alberta Energy and Utilities Board Rules of Practice, all documents filed in respect of this proceeding must be placed on the public record unless otherwise ordered by the Board, subject to the Freedom of Information and Protection of Privacy Act.

In accordance with Section 23.1 of the Alberta Energy and Utilities Board Rules of Practice, a person who intends to raise a question of constitutional law before the Board must give notice in accordance with Section 12 of the Administrative Procedures and Jurisdiction Act and its regulation.

In accordance with Section 38 of the Alberta Energy and Utilities Board Rules of Practice, witnesses must give evidence under oath or affirmation.
