AMENDMENT TO NOTICE OF RESCHEDULING OF HEARING
PROCEEDING NO. 1584140
OMERS ENERGY INC.
WARWICK FIELD

The Energy Resources Conservation Board (ERCB/Board) will hold a public hearing of Proceeding No. 1584140 at the ERCB offices, 640-5 Avenue S.W., Calgary, Alberta, commencing on February 10, 2009, at the hour of 9:00 a.m. All interveners to this proceeding must be present at the commencement of the hearing to register their appearance.

The ERCB had scheduled a public hearing of the Application at the Hyatt, 700 Centre Street SE, Calgary, Alberta, commencing on February 10, 2009, at the hour of 9:00 a.m.

Description of the Proceeding
On August 11, 2005, the Alberta Energy and Utilities Board (EUB) approved Application No. 1413237 and issued Well Licence No. 0336235 to OMERS Energy Inc. (OMERS) in accordance with Section 2.020 of the Oil and Gas Conservation Regulations (OGCR). The licence is for the drilling of a single well to obtain gas with 0% hydrogen sulphide (H2S) from the Colony Formation from a surface location at Legal Subdivision (LSD) 5, Section 4, Township 54, Range 14, West of the 4th Meridian. The well was drilled on August 14, 2005.

On January 25, 2008, the ERCB (formerly the EUB) approved Application No. 1557313 and issued Well Licence No. 0392996 to OMERS in accordance with Section 2.020 of the OGCR. The licence is for the drilling of a single well to obtain gas with 0% H2S from the Colony Formation from a surface location at LSD 5-4-54-14W4M. The well was drilled on January 30, 2008.

On June 20, 2008, the ERCB received letters from affected parties requesting that the Board conduct a review hearing relating to Well Licences No. 0336235 and 0392996, pursuant to Section 39 of the Energy Resources Conservation Act. On August 15, 2008, the ERCB granted the request for a review hearing and registered the hearing as Proceeding No. 1584140.

The purpose of the review hearing is to determine whether the Board should confirm, vary, or rescind its decision to grant Well License No. 0392996 and 0336235. The hearing shall focus on whether OMERS holds a valid and subsisting lease for the purpose of the issuance of well licences.

Requirement to File a Submission
If you have an interest in this matter, you are required to make a submission with respect to this application even if you have previously filed a submission with the Board or with OMERS Energy Inc. on this application. Submissions must include photocopies of all documentary evidence that you intend to present at the hearing (including, but not limited to, copies of expert reports) and a summary of all evidence you intend to present.

If you do not file submissions, the hearing of the Application may be cancelled and the ERCB will continue to process and may approve the Application without a hearing and without further notice.

How to File a Submission
Persons intending to make submissions with respect to the hearing of Proceeding No. 1584140 shall do so as follows:

OMERS Energy Inc. must file its submission, including any documents that it intends to tender as evidence at the hearing, on or before 4:00 p.m., January 15, 2009.

Montane Resources Ltd. and any other interested party must file its submission, including any documents that it intends to tender as evidence at the hearing, on or before 4:00 p.m., January 22, 2009.

OMERS Energy Inc. must file any reply it wishes to make on or before 4:00 p.m., January 29, 2009.

Applications for Confidentiality
In accordance with Section 13 of the Rules of Practice, all documents filed in respect of this proceeding must be placed on the public record. However, any party may make an application to the Board under Section 13(2) for confidentiality and serve a copy of such request on the other parties involved in the hearing. The Board may grant a request for confidentiality on any terms it considers appropriate, subject to the Freedom of Information and Protection of Privacy Act.
