NOTICE OF RESCHEDULING OF HEARING
APPLICATION NO. 1347912

Take Notice that the Alberta Energy and Utilities Board (EUB) had scheduled a public hearing of Application No. 1347912 at the Sandman Hotel, 888 – 7 Avenue SW, Calgary, Alberta, commencing on Wednesday, October 6, 2004, at the hour of 9:00 a.m. The EUB received a request to reschedule the hearing and has granted that request.

Therefore, Take Notice that the EUB will hold a public hearing of Application No. 1347912 at the offices of the EUB, 640 – 5 Avenue SW, Calgary, Alberta, commencing on Tuesday, November 9, 2004, at the hour of 9:00 a.m. All interveners to this proceeding must be present at the commencement of the hearing to register their appearance.

Nature of the Application

Luke Energy Ltd. applied

  • under section 48(1) of the Oil and Gas Conservation Act (the Act) for an order declaring AltaGas Services Inc. (AltaGas) as a common carrier of gas produced from the Marten Sparky A Pool and from two undefined Viking and Upper Clearwater pools, through a sweet gas pipeline extending from a tie in point at Legal Subdivision 10 of Section 23, Township 78, Range 5, West of the 5th Meridian (Lsd 10-23-78-5 W5M) (the 10-23 tie in) to an AltaGas gas processing plant located in Lsd 10-2-77-5 W5M;

  • under section 48(4)(a) of the Act for the EUB to designate the 10-23 tie in location as the point at which the common carrier shall take delivery of the gas to be transported under the common carrier order;

  • under section 48(4)(b) of the Act for the EUB to allocate the proportion of production to be taken by the common carrier from the subject pools; and

  • under section 56 of the Act for the above noted orders to be effective as of the date of the application, May 31, 2004.

The EUB has established the following filing deadlines for this hearing:

October 25, 2004 Final date for submissions by any parties having concerns respecting the application.

November 1, 2004 Final date for any response from the applicant to the submissions filed by concerned parties.

Notes

Any submission filed shall contain the following:

(a) a concise statement indicating

(i) the manner in which the intervener's rights may be directly and adversely affected by a decision of the Board on the proceeding,

(ii) the nature and scope of the intervener's intended participation,

(iii) the disposition of the proceeding that the intervener advocates, if any,

(iv) the facts the intervener proposes to show in evidence,

(v) the reasons why the intervener believes the Board should decide in the manner that the intervener advocates, and

(vi) the intervener's efforts, if any, to resolve issues associated with the proceeding directly with the applicant;

(b) the name, address in Alberta, telephone number, fax number and, if available, e-mail address of the intervener;

(c) if the intervener is represented by a representative, the name, address in Alberta, telephone number, fax number and, if available, e-mail address of the representative;

If you have an interest in this matter, you are required to make a submission with respect to this application even if you have previously filed a submission with the Board or with Luke Energy Ltd. on this application.

If there are no submissions received, this hearing may be cancelled and the EUB will continue to process the application without further notice or without a hearing.

In accordance with Section 38 of the Alberta Energy and Utilities Board Rules of Practice, witnesses must give evidence under oath or affirmation.

Submissions relating exclusively to compensation for land usage are not dealt with by the EUB but may be referred to the Alberta Surface Rights Board.

Any statements filed regarding this application become part of the public record and are accessible by the public.
