NOTICE OF RESCHEDULING OF HEARING
APPLICATION NO. 1360998
3R SAND LIMITED
SEVEN PERSONS AREA

Take Notice that the Alberta Energy and Utilities Board (EUB) had scheduled a public hearing of Application No. 1360998 at Govier Hall in the offices of the EUB, 640 5 Avenue SW, Calgary, Alberta commencing on January 10, 2006, at the hour of 9:00 a.m. The Board received a request from an interested party to reschedule the hearing and it agreed to grant the request.

Therefore, Take Notice that the EUB will hold a public hearing of Application No. 1360998 at Govier Hall in the offices of the EUB, 640 5 Avenue SW, Calgary, Alberta commencing on January 17, 2006, at the hour of 9:00 a.m. All interveners to this proceeding must be present at the commencement of the hearing to register their appearance.

Nature of the Application
3R Sand Limited (3R Sand) has applied pursuant to Section 26 of the Oil and Gas Conservation act for an amendment it its existing Oilfield Waste Management Facility to reduce the scope of the existing approval from regulating all of the facility to regulating only the Blowback Dewatering Station and Raw Material/Dewatered Sand Pad. Alternatively, if the Board does not grant the request to reduce the scope of the existing approval, 3R Sand has applied under Section 26 of the Oil and Gas Conservation Act to amend 11 points of seven conditions associated with its original approval, remove two storage buildings and three storm water retention ponds from the existing approval, and, under Section 16.643(2) of the Oil and Gas Conservation Regulations, to reduce the amount of security required to be provided to the Board for the facility.

The purpose of the facility is to recycle frac sand and to process and size raw sand for a variety of uses including frac sands. The facility is located at Legal subdivision 4, Section 11, Township 11, Range 7 West of the 4th Meridian, approximately 2.4 kilometers northeast of the Hamlet of Seven Persons.

Interested Parties
A EUB staff group (ESG) has been formed and intends to make a submission at any proceeding respecting the above application.
