AMENDED NOTICE OF HEARING

Take Notice that the Alberta Energy and Utilities Board (EUB) has scheduled a public hearing of Application No. 1426300 at the Coast Terrace Inn, South, 4440 Gateway Blvd, Edmonton, Alberta, commencing on Tuesday, June 27, 2006 at the hour of 9:00 a.m. Notice of Hearing for Application No. 1426300 was issued from the offices of the EUB on March 23 and amended on May 16, 2006. The Board received a request from interested parties to reschedule the hearing submission dates and it agreed to grant the request.
Therefore, Take Notice that the filing dates for the submission of information to the EUB are amended as set out below. All interveners to this proceeding must be present at the commencement of the hearing to register their appearance.
The matters to be considered include:
- need, location, and environmental impacts of the proposed well
- health and safety impacts of the proposed well, including emergency response
- other impacts specifically related to the proposed well
- public consultation and corporate structure of Burlington Resources Canada Ltd.
This list of issues, although not exhaustive, was advanced by interested parties at the Prehearing meeting held in Edmonton on February 16, 2006.
Nature of the Application
Burlington Resources Canada Ltd. (Burlington) has applied pursuant to Section 2.020 of the Oil and Gas Conservation Regulations (the OGCR), for authorization to drill a Level 3 critical sour gas well. The well would have a surface location of Legal Subdivision 4, Section 34, Township 52, Range 26, West of the 5th Meridian (the 4-34 well). The purpose of the well would be to produce natural gas from the Leduc Formation. The maximum hydrogen sulphide (H2S) concentration would be 234.6 moles per kilomole (23.46 per cent). The 4-34 well would have a maximum calculated Emergency Planning Zone (EPZ) of 4.34 kilometres (km). The proposed well would be located approximately 16.8 km northwest of Hinton, Alberta.

To File a Submission
Any person intending to make a submission with respect to the hearing of Application No. 1426300 shall file on or before 12:00 noon on Monday, June 5, 2006. One copy of the submission is to be sent to Burlington and ten copies to Julia Fulford, Application Coordinator, at the addresses listed above.
Board Approved Hearing Schedule
The following is the schedule for the hearing process:
June 5, 2006 Interveners file submissions on or before 12:00 noon
June 19, 2006 Burlington files a response to intervener submissions on or before 12:00 noon
June 27, 2006 Hearing commences in Edmonton at 9:00 a.m.
Notes
Any submission filed shall contain the following:
(a) a concise statement indicating
(i) the manner in which the intervener’s rights may be directly and adversely affected by a decision of the Board on the proceeding,
(ii) the nature and scope of the intervener’s intended participation,
(iii) the disposition of the proceeding that the intervener advocates, if any,
(iv) the facts the intervener proposes to show in evidence,
(v) the reasons why the intervener believes the Board should decide in the manner that the intervener advocates, and
(vi) the intervener’s efforts, if any, to resolve issues associated with the proceeding directly with the applicant;
(b) the name, address in Alberta, telephone number, fax number and, if available, e-mail address of the intervener;

If you have an interest in this matter, you are required to make a submission with respect to this application even if you have previously filed a submission with the Board or with Burlington on this application.
If there are no submissions received, this hearing may be cancelled and the EUB will continue to process the application without further notice or without a hearing.
In accordance with Section 38 of the Alberta Energy and Utilities Board Rules of Practice, witnesses must give evidence under oath or affirmation.
Submissions relating exclusively to compensation for land usage are not dealt with by the EUB but may be referred to the Alberta Surface Rights Board.
Note: In accordance with Section 12 of the Alberta Energy and Utilities Board Rules of Practice, all documents filed in respect of this proceeding must be placed on the public record unless otherwise ordered by the Board.
