NOTICE OF HEARING
APPLICATIONS NO. 1439811, 1439815, 1439818, 1439821, 1443511, 1443514 and 1443942

Take Notice that the Alberta Energy and Utilities Board (EUB) will hold a public hearing of Applications 1439811, 1439815, 1439818, 1439821, 1443511, 1443514 and 1443942 at the Greenway Inn, 5402 Hwy 2A, Lacombe, Alberta, commencing on Thursday July 20, 2006, at the hour of 9:00 a.m. All interveners to this proceeding must be present at the commencement of the hearing to register their appearance.

Nature of the Applications
Fairborne Energy Ltd. has applied pursuant to Section 2.020 of the Oil and Gas Conservation Regulations requesting approval to drill six vertical natural gas wells from six surface locations (listed below).  The maximum hydrogen sulphide (H2S) concentration for all of the proposed wells is expected to be 0.0 moles per kilomole (mol/kmol) (0.0 per cent).  There are no associated emergency planning zones with the proposed locations. The proposed wells would be located approximately 5.5 km south of Tees.  The purpose of the following well applications is to obtain coal bed methane production from the Edmonton Group.

• Application 1439811: application for a well to be drilled from Legal Subdivision (LSD) 12, Section 1, Township 40, Range 24 West of the 4th Meridian.
• Application 1439815: application for a well to be drilled from LSD 1-2-40-24W4M. 
• Application 1439818: application for a well to be drilled from LSD 1-11-40-24W4M.
• Application 1439821: application for a well to be drilled from LSD 12-2-40-24W4M.

The purpose of the following wells would be to obtain CBM development from the Edmonton Group as well as natural gas production from the Belly River Group.

• Application 1443511: application for a well to be drilled from 9-1-40-24W4M.
• Application 1443514: application for a well to be drilled from 9-2-40-24W4M. 

Fairborne Energy Ltd. has applied in accordance with Part 4 of the Pipeline Act for approval to construct and operate 7 pipeline segments (listed below) for the purpose of transporting natural gas with a maximum H2S concentration of 0.0 mol/kmole.  All pipelines would transport natural gas production. The proposed pipeline segments would be located approximately 5.5 km south of Tees.

• first line segment would run from LSD 6-2-40-24W4M (well) to a pipeline tie in point at 10-35-39-24W4M. This segment would be 1.92 km in length and have an outside diameter (OD) of 168.3 millimeters (mm)
• second line segment would run from LSD 3-2-40-24W4M (well) to a pipeline tie in point at 6-2-40-24W4M.  This segment would be 0.59 km in length and would have an OD of 114.3 mm
• third line segment would run from 12-2-40-24W4M (well) to a pipeline tie in point at 6-2-40-24W4M, and would be 0.82 km in length with an OD of 114.3 mm.
• fourth line segment would run from LSD 9-2-40-24W4M (well) to a tie in point at LSD 8-2-40-24W4M, and would be 0.30 km in length with an OD of 114.3 mm
• the fifth segment would run from LSD 12-1-40-24W4M to a pipeline tie in point at 5-1-40-24W4M and would be 0.52 km in length with an OD of 114.3 mm
• the sixth segment would run from LSD 6-1-40-24W4M (well) to a pipeline tie in point at LSD 8-2-40-24W4M, and would be 0.92 km in length with an OD of
114.3 mm
• the last segment would run from LSD 9-1-40-24W4M (well) to a pipeline tie in pint at LSD 2-12-40-24W4M, and would be 0.90 km in length with an OD of 114.3 mm.

Notes
Any submission filed shall contain the following:

(a) a concise statement indicating

(i) the manner in which the intervener’s rights may be directly and adversely affected by a decision of the Board on the proceeding,
(ii) the nature and scope of the intervener’s intended participation,
(iii) the disposition of the proceeding that the intervener advocates, if any,
(iv) the facts the intervener proposes to show in evidence,
(v) the reasons why the intervener believes the Board should decide in the manner that the intervener advocates, and
(vi) the intervener’s efforts, if any, to resolve issues associated with the proceeding directly with the applicant;

b) the name, address in Alberta, telephone number, fax number and, if available, e-mail address of the intervener;

If there are no submissions received, this hearing may be cancelled and the EUB will continue to process the application without further notice or without a hearing.

In accordance with Section 38 of the Alberta Energy and Utilities Board Rules of Practice, witnesses must give evidence under oath or affirmation.

Submissions relating exclusively to compensation for land usage are not dealt with by the EUB but may be referred to the Alberta Surface Rights Board.
