NOTICE OF PREHEARING MEETING
APPLICATION NO.  1506785
BERKLEY RESOURCES INC.
CROSSFIELD EAST FIELD

Berkley Resources Inc. (Berkley) has applied to the Alberta Energy and Utilities Board (EUB) for a well licence. A descriptive summary of the application is included below.

The EUB has decided to hold a public hearing respecting the above application. In addition, the EUB will hold a prehearing meeting concerning the above application at the Best Western Regency Inn, located at 121 Edmonton Trail, Airdrie, Alberta, on Wednesday, December 5, 2007, commencing at 9:00 a.m. The matters to be considered include, but would not be limited to:
• establishing the scope and purpose of the hearing, including relevant issues to be examined,
• establishing the timing and location of the public hearing,
• identifying the procedures to be used in the hearing,
• identifying the participants and their roles in the hearing,
• discussing the funding of the participants, and
• any other matters as necessary.

The EUB will confirm the actual hearing dates after hearing from those persons participating in the prehearing meeting.

This prehearing meeting is not being held to hear evidence or argument pertaining to the merits of these applications or objections. It is to obtain parties’ views on the topics listed above. Parties will be given an opportunity to present evidence, cross-examine witnesses, and make arguments regarding the merits of the applications at the public hearing of these applications.

Nature of Application
Berkley has applied pursuant to Section 2.020 of the Oil and Gas Conservation Regulations for a licence to drill a Level 2 critical sour well from a surface location in Legal Subdivision (LSD) 12 of Section 9, Township 28, Range 1, West of the 5th Meridian to a projected bottom hole location in LSD 11-9-28-1W5M.  The maximum hydrogen sulphide (H2S) concentration would be approximately 447.9 moles per kilomole (44.79 per cent) and the cumulative completion/servicing H2S release rate would be 4.4220 cubic metres per second (m3/s) with a corresponding calculated emergency planning zone of 6.32 kilometres (km). Berkley adopted an emergency planning zone of 7.70 km for initial drilling and completions operations. The purpose of the well would be to obtain gas production from the Crossfield Member.  The proposed well would be located approximately 4.8 kilometres south and west of the Town of Crossfield.

Filing of Submissions Respecting the Prehearing Meeting
It is not necessary to file any written views prior to the prehearing meeting. Presentations may be made verbally at the prehearing meeting. However, if any person wishes to file a written submission at the prehearing meeting, please provide a copy of the complete submission to Marty Douglas, Application Coordinator, and one copy to Berkley.

Further, any party wishing to file a written submission prior to the prehearing meeting should do so prior to November 21, 2007. One copy of the submission is to be sent to Berkley and one copy to Marty Douglas, Application Coordinator, at the addresses noted above.

In accordance with Section 12 of the Alberta Energy and Utilities Board Rules of Practice, all documents filed in respect of this proceeding must be placed on the public record unless otherwise ordered by the Board, subject to the Freedom of Information and Protection of Privacy Act.

In accordance with Section 23.1 of the Alberta Energy and Utilities Board Rules of Practice, a person who intends to raise a question of constitutional law before the Board must give notice in accordance with Section 12 of the Administrative Procedures and Jurisdiction Act and its regulation.
