AMENDED NOTICE OF HEARING
APPLICATIONS NO. 1294515 AND 1294863
RETLAW AND VAUXHALL FIELDS
OWL RIVER RESOURCES LTD.

Take Notice that examiners appointed by the Alberta Energy and Utilities Board (EUB) will hold a public hearing of Applications No. 1294515 and 1294863 at the offices of the Board, 640 5th Avenue SW, Calgary, Alberta, commencing on June 10, 2003, at 9:00 a.m. All interveners to this proceeding must be present at the commencement of the hearing to register their appearance.

Nature of the Applications

Application No. 1294515: Owl River Resources Ltd. (Owl River) applied pursuant to section 80 of the Oil and Gas Conservation Act (the Act) for an order prescribing that all tracts within the drilling spacing unit comprising Section 30 of Township 12, Range 17, West of the 4th Meridian (Section 30-12-17 W4M), be operated as a unit for the production of gas from the Second White Speckled Shale, through the well with the unique identifier of 00/02-30-012-17W4.

The applicant has requested, among other things, that costs and revenues under the pooling order be allocated on a geological basis, with a 42.68 per cent allocation for the southwest quarter of the section and a 57.32 per cent allocation for the remainder of the section. In addition, the applicant requested that it be named the operator of the well to be produced under the order, and that the maximum penalty allowed under the Act be applied to a tract's share of the costs of drilling the well to, and completing it in, the formation(s) named in the order, if the tract owner does not pay its share of those costs within 30 days of the later of the pooling order being issued, the tract owner being given written notice of its share of costs, and the well in question being placed on production.

Application No. 1294863: Owl River applied pursuant to section 80 of the Act for an order prescribing that all tracts within the drilling spacing unit comprising Section 20-12-17 W4M, be operated as a unit for the production of gas from the Second White Speckled Shale, through the well with the unique identifier of 00/16-20-012-17W4.

The applicant has requested, among other things, that costs and revenues under the pooling order be allocated on a geological basis, with a 5.1 per cent allocation for the northwest quarter of the section and a 94.9 per cent allocation for the remainder of the section. In addition, the applicant requested that it be named the operator of the well to be produced under the order, and that the maximum penalty allowed under the Act be applied to a tract's share of the costs of drilling the well to, and completing it in, the formation(s) named in the order, if the tract owner does not pay its share of those costs within 30 days of the later of the pooling order being issued, the tract owner being given written notice of its share of costs, and the well in question being placed on production.

May 26, 2003:         Final date for submissions by any parties having concerns respecting the applications.

June 2, 2003:           Final date for any response from the applicant to the submissions filed by concerned parties.

Notes

Any submission filed shall contain information detailing:

(i)      the desired disposition of the applications,

(ii)      the facts substantiating the position of the submitter, and

(iii)     the reasons why the submitter believes that the EUB should decide in the manner advocated.

 

In accordance with section 38 of the Alberta Energy and Utilities Board Rules of Practice, witnesses must give evidence under oath or affirmation.

If there are no valid objections received, this hearing may be cancelled and the EUB will continue to process the applications without further notice or without a hearing.
