AMENDED NOTICE OF HEARING

APPLICATION NO.  1453533

BEARSPAW PETROLEUM LTD.

CROSSFIELD FIELD

 

Take Notice that the EUB has scheduled a public hearing at the Glenmore Inn and Conference Centre, 2720 Glenmore Trail SE, Calgary, Alberta, commencing on Tuesday, January 9, 2007.  The public hearing was scheduled to consider Application Nos. 1453533 & 1485011. By letter dated November 27, 2006, the Board received a request from the applicant to withdraw Application No. 1485011. The Board has granted the request.  Accordingly, the public hearing scheduled for January 9, 2007 will not consider Application No. 1485011.  

 

The public hearing of Application No. 1453533 will commence on Tuesday, January 9, 2007, at the hour of 9:00 a.m.  All interveners to the proceeding must be present at the commencement of the hearing to register their appearance.

 

Nature of the Application

 

Bearspaw Petroleum Ltd. (Bearspaw) submitted Application No. 1453533 in accordance with Part 4 of the Pipeline Act for approval to construct and operate a pipeline for the purpose of transporting natural gas from a well at Legal Subdivision (LSD) 10, Section 24, Township 24, Range 28, West of the 4th Meridian, to a pipeline tie-in point at LSD 5-36-24-28W4M. The proposed pipeline would be approximately 3.2 kilometres (km) in length, with a maximum outside diameter of 88.9 millimetres (mm), and would transport natural gas with a maximum hydrogen sulphide (H2S) concentration of 20 moles per kilomole (mol/kmol) (2.0 per cent). The proposed pipeline would be operated as a level-1 pipeline. A second pipeline would also be constructed to transport fuel gas from the existing pipeline tie-in at LSD 5-36-24-28W4M to the well located at LSD 10-24-24-28W4M. It would be constructed parallel to the first proposed pipeline, in the same right-of-way, with a length of approximately 3.2 km and an outside diameter of 88.9 mm. It would have an H2S content of 0.00 mol/kmol (0.0 per cent). The proposed pipelines would be located approximately 2.5 km northeast of the Town of Chestermere.

To File a Submission

Any person intending to make a submission with respect to the hearing of Application No. 1453533 must file on or before 4:00 p.m., Friday, December 15, 2006. Send one copy of your submission to the applicant and ten copies to the EUB care of the application coordinator at the names and addresses listed above.

 

Notes

Any submission filed must contain the following:

 

(a)    a concise statement indicating

(i)     the manner in which the intervener’s rights may be directly and adversely affected by a decision of the Board on the proceeding,

(ii)      the nature and scope of the intervener’s intended participation,

(iii)     the disposition of the proceeding that the intervener advocates, if any,

(iv)     the facts the intervener proposes to show in evidence,

(v)      the reasons why the intervener believes the Board should decide in the manner that the intervener advocates, and

(vi)     the intervener’s efforts, if any, to resolve issues associated with the proceeding directly with the applicant;

(b)        the name, address in Alberta, telephone number, fax number and, if available, e-mail address of the intervener;

(c)        if the intervener is represented by a representative, the name, address in Alberta, telephone number, fax number and, if available, e-mail address of the representative; and

(d)        if the intervener is an unincorporated organization, the nature of the intervener’s membership.

If you have an interest in this matter, you are required to make a submission with respect to this application even if you have previously filed a submission with the Board or with Bearspaw Petroleum Ltd. on this application.

 

If there are no submissions received, this hearing may be cancelled and the EUB will continue to process the application without further notice or without a hearing.

 

Submissions relating exclusively to compensation for land usage are not dealt with by the EUB but may be referred to the Alberta Surface Rights Board.

 

In accordance with Section 12 of the Alberta Energy and Utilities Board Rules of Practice, all documents filed in respect of this proceeding must be placed on the public record unless otherwise ordered by the Board.

 

In accordance with Section 23.1 of the Alberta Energy and Utilities Board Rules of Practice, a person who intends to raise a question of constitutional law before the Board must give notice in accordance with Section 12 of the Administrative Procedures and Jurisdiction Act and its regulation.

 

In accordance with Section 38 of the Alberta Energy and Utilities Board Rules of Practice, witnesses must give evidence under oath or affirmation.
