ALTALINK INVESTMENT MANAGEMENT LTD.

REQUESTED RELIEF OF SECTION 101(2) OF THE PUB ACT 

Take Notice that the Alberta Energy and Utilities Board (the EUB) may continue to process this application without further notice if no objections are received on or before July 7, 2003. 

Nature of the Application

By letter dated June 10, 2003, AltaLink Investment Management Ltd. (AIML) applied to the EUB pursuant to section 101(4) of the PUB Act for an order declaring that section 101(2) of the PUB Act does not apply to AIML in respect of the classes of transactions described in section 101(2). 

AIML submitted that it was appropriate to grant this Application because AIML does not directly own or operate any public or electric utility assets. Therefore, AIML submitted that any of the transactions undertaken by AIML described in section 101(2) would not have any affect on the public utility service provided to the Alberta public. AIML also noted that relief under section 101(2) would enable AIML to manage its unregulated activities within Alberta and regulated activities outside of Alberta in a flexible and efficient manner.  

AIML is the general partner of AltaLink Investments, L.P. (AILP) and AILP owns 100% of the limited partnership interest in AltaLink, L.P. (ALP). ALP owns 100% of the beneficial interest in certain electricity transmission assets and business formerly owned and operated by TransAlta Utilities Corporation.
