APPLICATIONS NO. 1287720 AND 1282390 AND

PROCEEDING NO. 1280440

BAYTEX ENERGY LTD. AND PRIMEWEST ENERGY INC.

HARMON VALLEY FIELD

Take Notice that the Alberta Energy and Utilities Board (EUB) will hold a public hearing of Applications No. 1287720 and 1282390, and Proceeding No. 1280440, at the offices of the EUB, 640 5th Avenue SW, Calgary, Alberta, commencing on Tuesday, May 13, 2003, at 9:00 a.m. All interveners to this proceeding must be present at the commencement of the hearing to register their appearance.

Nature of Application No. 1287720

Baytex Energy Ltd. (Baytex) applied

                     under section 48(1) of the Oil and Gas Conservation Act (the Act) for an order declaring PrimeWest Energy Inc. (PrimeWest) to be a common carrier of gas produced from the Fahler, Bluesky, and Gething pools encountered by the wells located in Legal Subdivision 14 of Section 5, Township 81, Range 19, West of the 5th Meridian (LSD 14-5-81-19 W5M), LSD 16-6-81-19 W5M, and LSD 3-17-81-19 W5M, through pipelines extending from LSD 3-8-81-19 W5M to LSD 10-27-78-19 W5M as described in the application,

                     under section 48(4) of the Act for the EUB to distribute the production to be taken from each producer in the Harmon Valley Bluesky A Pool,

                     under section 48(4) of the Act for the EUB to designate the delivery point for the common carrier to take delivery of gas to be at the field compression facility at LSD 3-8-81-19 W5M,

                     under section 55(3) of the Act for the EUB to set transportation fees, and

                     under section 56 of the Act for the common carrier order to be made effective as of October 10, 2002.

Nature of Application No. 1282390

PrimeWest applied under section 7.001 of the Oil and Gas Conservation Regulations to construct and operate a sweet gas compressor station in LSD 3-8-81-19 W5M.

Nature of Proceeding No. 1280440

Baytex applied under section 40 of the Energy Resources Conservation Act for the EUB to review Pipeline Licence No. 33947, issued to PrimeWest. In accordance with Part 4 of the Pipeline Act, PrimeWest submitted Application No. 1271281 on May 31, 2002 for approval to construct and operate a natural gas pipeline from an existing well located in LSD 3-8-81-19 W5M to a pipeline tie-in point at LSD 6-12-80-19 W5M. The pipeline would be approximately 12.7 kilometres in length and would have a 168.3-millimetre (mm) outside diameter (OD). On June 3, 2002, the application was approved and Pipeline Licence No. 33947 was issued.

April 14, 2003:          Final date for submissions by any parties having concerns respecting any of the applications.

April 28, 2003:          Final date for any response from an applicant to the submissions filed by concerned parties.

Notes

Any submission filed shall contain information detailing:

         (i)      the desired disposition of the applications,

         (ii)      the facts substantiating the position of the submitter, and

(iii)     the reasons why the submitter believes that the EUB should decide in the manner advocated.

In accordance with section 38 of the Alberta Energy and Utilities Board Rules of Practice, witnesses must give evidence under oath or affirmation.

If there are no bona fide objections received, this hearing may be cancelled and the EUB will continue to process the applications without further notice or without a hearing.
