Take Notice that the Alberta Energy and Utilities Board (EUB/Board) will hold a public hearing of Applications No. 1302928 and 1327929 at the Greenway Inn, 5401 Highway 2A, Lacombe, Alberta, commencing on Tuesday, June 1, 2004, at 9:00 am. All interveners to this proceeding must be present at the commencement of the hearing to register their appearance.
Nature of Application No. 1302928
Apache Canada Ltd. (Apache) applied pursuant to Section 79, Subsection 4 of the Oil and Gas Conservation Act and Section 5.190 of the Oil and Gas Conservation Regulations for the suspension of the drilling spacing units and target area provisions and to establish a holding in Section 18 of Township 41, Range 23, West of the 4th Meridian (Section 18-41-23 W4M), for the production of gas from the coals of the Edmonton Group. Apache further proposes that the holding be subject to the following provisions:
- There shall be an interwell distance of a minimum of 200 meters at the producing horizon.
- Wells producing within the holding shall be at least 150 meters from the boundaries of the holding.

Apache applied pursuant to Section 79, Subsection 4 of the Oil and Gas Conservation Act and Section 5.190 of the Oil and Gas Conservation Regulations for the suspension of the drilling spacing units and target area provisions and to establish a holding in Sections 29, 30, and 32-40-21 W4M, for the production of gas from the coals of the Edmonton Group. Apache further proposes that the holding be subject to the following provisions:
- There shall be an interwell distance of a minimum of 200 meters at the producing horizon.
- Wells producing within the holding shall be at least 200 meters from the boundaries of the holding.

April 26, 2004 Final date for the EUB to provide information requests to the applicant.
May 17, 2004 Final date for submissions by any parties having concerns respecting any of the applications.
May 25, 2004 Final date for any response from the applicant to the submissions filed by concerned parties.

Notes
Any submission filed shall contain information detailing:
(i) the desired disposition of the application,
(ii) the facts substantiating the position of the submitter,
(iii) the reasons why the submitter believes that the Board should decide in the manner advocated, and
(iv) how the proposed project, if approved, may directly and adversely affect the submitter.
In accordance with section 38 of the Alberta Energy and Utilities Board Rules of Practice, witnesses must give evidence under oath or affirmation.
Submissions relating exclusively to compensation for land usage are not dealt with by the EUB but may be referred to the Alberta Surface Rights Board, or, in the case of trapping issues, to the Trappers Compensation Board.
If no submissions are received, this hearing may be cancelled and the EUB will continue to process the application without further notice or without a hearing.
