Take Notice that Milner Power Inc. (Milner) has applied to the Alberta Energy and Utilities Board (EUB) and Alberta Environment (AENV) for a Permit, Licence and Approval for the Milner Power #14 Mine project to develop, operate, and reclaim an underground coal mine, the associated infrastructure, and haulroad.  The proposed project will be located in the Grande Cache area, approximately 3.2 kilometres northeast of the Town of Grande Cache.  The proposed project is being planned as an underground room-and-pillar operation with the potential to produce about 480,000 tonnes of raw coal per year.

This Notice of Application is being distributed to advise interested persons that the applications are available, and that the EUB, AENV and other government departments are now undertaking a review of the applications.

Nature of the Application
In support of their proposal, Milner has prepared and submitted the following applications:

• Application No. 1521988 to the EUB, pursuant to Sections 10(1)(b) and 11(a) of the Coal Conservation Act and Sections 4(1), 4(2), 8(1) and 8(2) of the Coal Conservation Regulations. In support of its proposal and as part of this application to the EUB, Milner has also submitted an EPEA approval application to AENV. The EPEA application forms part of the application to the EUB.

• Application No. 001-234735 to AENV, pursuant to the Environmental Protection and Enhancement Act (EPEA) for an EPEA approval for the construction, operation, and reclamation of a mine and associated infrastructure [as per the EPEA Activities Designation Regulation AR 276/2003 - Schedule 1 Division 3(b)], and an approval under EPEA for operation of a wastewater system (other than a wastewater lagoon) at the mine site [as per EPEA Activities Designation Regulation – Schedule 1, Division 2, Part 7(g) and Part 7(g)(i)(C)].
• Application No. 001-00241239 made under the Water Act for Licenses/Approvals to build a drainage system and to withdraw water for consumptive and non-consumptive purposes from rainfall and snowmelt runoff.

Further Take Notice that pursuant to Section 73 of EPEA, and Section 109 of the Water Act, any person who is directly affected by EPEA Application No. 001-234735 or the Water Act Application No. 001-00241239, may submit a written statement of concern to:

To File a Statement of Concern
Statements of concern under EPEA and the Water Act must be submitted by November 16, 2007. Failure to file a statement of concern may affect the right to file a Notice of Objection (on appeal) with the Environmental Appeal Board. Please quote Application No. 001-234735 (EPEA) or Application No. 001-00241239 (Water Act) when submitting a statement of concern. If no statements of concern are received, the EPEA and Water Act applications may be approved without further notice.

Note:  In accordance with Section 12 of the Alberta Energy and Utilities Board Rules of Practice, and Section 35(1) of the Environmental Protection and Enhancement Act all documents filed in respect of these applications must be placed on the public record.
