NOTICE OF HEARING
APPLICATIONS NO. 1566779, 1567143, 1567144, 1567145, 1567146, 1567147, 1567148, 1567149, 1561750, 1569646, 1569673, AND 1585641

TWINNING FIELD

The Energy Resources Conservation Board (ERCB/Board) will hold a public hearing of Applications No. 1566779, 1567143, 1567144, 1567145, 1567146, 1567147, 1567148, 1567149, 1561750, 1569646, 1569673, and 1585641 at the Three Hills Community Centre, 222 Main Street, Three Hills, Alberta, commencing on February 11, 2009, at 9:00 a.m. All interveners to this proceeding must be present at the commencement of the hearing to register their appearance.

Description of the Applications

Application 1566779
Pengrowth Corporation (Pengrowth) submitted an application, in accordance with Part 4 of the Pipeline Act, for approval to construct and operate nine pipelines for the purpose of transporting oil effluent from Legal Subdivision (LSD) 10 of Section 32, Township 32, Range 23, West of the 4th Meridian to LSD 15-32-32-23W4M, from LSD 09-29-32-23W4M to LSD 7-32-32-23W4M, from LSD15-29-32-23W4M to LSD 7-32-32-23W4M, from LSD 2-32-32-23W4M to LSD 7-32-32-23W4M, from LSD 14-32-32-23W4M to LSD 11-32-32-23W4M, from LSD 11-32-32-23W4M to LSD 15-32-32-23W4M, from LSD 3-32-32-23W4M to LSD 11-32-32-23W4M, from LSD 6-32-32-23W4M to LSD 11-32-32-23W4M, and from LSD 7-32-32-23W4M to LSD 15-32-32-23W4M. The proposed pipelines would be approximately 0.78 kilometres (km), 1.66 km, 0.75 km, 0.64 km, 0.7 km, 1.14 km, 0.96 km, 0.59 km, and 1.22 km in length, respectively. The pipelines would have a maximum outside diameter of 88.9 millimetres (mm) and 114.3 mm and would transport oil effluent with a maximum hydrogen sulphide (H2S) concentration of 0.0 moles per kilomole (mol/kmol) (0.0 per cent). The proposed pipeline would be located approximately 2.54 km south of Trochu.

Applications 1567143, 1567144, 1567145, 1567146, 1567147, 1567148, 1577149, and 1567150
Pengrowth submitted eight applications, in accordance with Section 2.020 of the Oil and Gas Conservation Regulations (OGCR), for eight licences to drill eight vertical wells from surface locations in LSD 14-32-32-23W4M, LSD 11-32-32-23W4M, LSD 10-32-32-23W4M, LSD 6-32-32-23W4M, LSD 3-32-32-23W4M, LSD 2-32-32-23W4M, LSD 15-29-32-23W4M, and LSD 9-29-32-23W4M. The maximum H2S concentration would be approximately 0.00 mol/kmol (0.0 per cent). The purpose of the wells would be to obtain crude oil production from the Ostracod Sands. The proposed wells would be located approximately 2.54 km south of Trochu.
 
Applications 1569646 and 1569673
Pengrowth submitted two applications, in accordance with Section 7.001 of the OGCR, requesting approval to construct and operate two multiwell oil satellites in LSD 7-32-32-23W4M and LSD 11-32-32-23W4M in the Twinning Field. The wellsite facilities would consist of a separator and tank. The proposed satellites would be located approximately 2.54 km south of Trochu.

Application 1585641
Pengrowth submitted an application, in accordance with Section 7.001 of the OGCR, requesting approval to construct and operate a multiwell oil battery in LSD 15-32-32-23W4M in the Twinning Field. The wellsite facility would consist of a group and test separator, booster compressor, treater, and free-water knockout tank. The purpose of the facility would be to separate and measure production from proposed oil wells located at LSD 10-32-32-23W4M, LSD 11-32-32-23W4M, and LSD 7-32-32-32-23W4M. The proposed battery would be located approximately 2.54 km south of Trochu.

Any person intending to make a submission with respect to the hearing of Applications No. 1566779, 1567143, 1567144, 1567145, 1567146, 1567147, 1567148, 1567149, 1561750, 1569646, 1569673, and 1585641 must file on or before 4:00 p.m., January 20, 2009. Requirement to File a Submission
If you have an interest in this matter, you are required to make a submission with respect to this application even if you have previously filed a submission with the Board or with Pengrowth on this application.

If no submissions are received, the hearing in this matter may be cancelled and the ERCB will continue to process and may approve the application without further notice or without a hearing.

Contents of a Submission
Under Section 24(2) of the Energy Resources Conservation Board Rules of Practice (Rules of Practice), any submission filed must contain the following:

(a) a concise statement indicating

(i) the manner in which the intervener’s rights may be directly and adversely affected by a decision of the Board on the proceeding,

(ii) the nature and scope of the intervener’s intended participation,

(iii) the disposition of the proceeding that the intervener advocates, if any,

(iv) the facts the intervener proposes to show in evidence,

(v) the reasons why the intervener believes the Board should decide in the manner that the intervener advocates, and

(vi) the intervener’s efforts, if any, to resolve issues associated with the proceeding directly with the applicant;

(b) the name, address in Alberta, telephone number, fax number and, if available, e-mail address of the intervener;

(c) if the intervener is represented by a representative, the name, address in Alberta, telephone number, fax number and, if available, e-mail address of the representative; and

(d) if the intervener is an unincorporated organization, the nature of the intervener’s membership.

Compensation Issues
Submissions relating exclusively to compensation for land usage are not dealt with by the ERCB and should be referred to the Alberta Surface Rights Board.

Applications for Confidentiality
In accordance with Section 13 of the Rules of Practice, all documents filed in respect of this proceeding must be placed on the public record. However, any party may make an application to the Board under Section 13(2) for confidentiality and serve a copy of such request on the other parties involved in the hearing. The Board may grant a request for confidentiality on any terms it considers appropriate, subject to the Freedom of Information and Protection of Privacy Act.

Questions of Constitutional Law
In accordance with Section 25 of the Rules of Practice, a person who intends to raise a question of constitutional law before the Board must give notice in accordance with Section 12 of the Administrative Procedures and Jurisdiction Act and its regulation.
