Take Notice that the Energy Resources Conservation Board (ERCB/Board) will conduct a written hearing of Applications No. 1613543 and 1616123 (the Applications) in accordance with Section 47 of the Energy Resources Conservation Board Rules of Practice (Rules of Practice).

Description of the Applications

Application No. 1613543
Sunshine Oilsands Ltd. has applied, pursuant to Section 9 of the Rules of Practice, for the interim shut in of 104 wells within and around the Liege Wabiskaw O Pool. The wells are listed in an appendix and posted along with this notice on the ERCB Web site www.ercb.ca.

Application No. 1616123
Total E&P Canada Ltd. has applied, pursuant to Section 3(5) of the Oil Sands Conservation Regulation, for the interim shut in of the well at Legal Subdivision 6, Section 4, Township 94, Range 17, West of the 4th Meridian (well 6-4-94-17W4).

Requirement to File a Submission
If you have an interest in this matter and wish to make submissions or submit evidence to the hearing of the Applications, you must file submissions with respect to these Applications even if you have previously filed a submission with the Board or with the applicants on these Applications. Submissions must include copies of all documentary evidence that you intend to rely on (including, but not limited to, copies of expert reports) and a summary of all evidence you intend to rely on.

If no submissions opposing the Applications are filed, the hearing of the Applications may be cancelled and the ERCB will continue to process and may approve the Applications without a hearing and without further notice.

Schedule for Filing Submissions
The Board has established the following filing deadlines for this hearing:

July 27, 2009

For submissions of any additional information by the applicants and those supporting the interim shut in of gas

August 24, 2009

For reply submissions from interveners

August 31, 2009

For response by the applicants and those supporting the shut in of gas

Interveners must file reply submissions on or before the date listed above through the Digital Data Submission (DDS) system, Proceeding ID 169.

The applicants and those supporting the shut in of gas must file any additional information and response submissions on or before the dates listed above through DDS, Proceeding ID 169.

Contents of Submissions
The contents of submissions filed must comply with the ERCB's Rules of Practice.

Applications for Confidentiality
In accordance with Section 13 of the Rules of Practice, all documents filed in respect of this hearing must be placed on the public record. However, any party may make an application to the Board under Section 13(2) for confidentiality and serve a copy of such request on the other parties involved in the hearing. The Board may grant a request for confidentiality on any terms it considers appropriate, subject to the Freedom of Information and Protection of Privacy Act.

Questions of Constitutional Law
In accordance with Section 25 of the Rules of Practice, a person who intends to raise a question of constitutional law before the Board must give notice, in accordance with Section 12 of the Administrative Procedures and Jurisdiction Act and its regulation.
