NOTICE OF RESCHEDULING OF HEARING
APPLICATIONS NO. 1494136 AND 1580112
PARAMOUNT ENERGY OPERATING CORPORATION
CORNER MCMURRAY C POOL
ATHABASCA OIL SANDS AREA

Take Notice that the Energy Resources Conservation Board (ERCB/Board) had scheduled a public hearing of Applications No. 1494136 and 1580112 at the ERCB’s offices, 640 - 5th Avenue SW, Calgary, Alberta commencing on Monday, November 24, 2008, at the hour of 1:00 p.m. On August 11, 2008, the Board received a request from Paramount Energy Operating Corporation (Paramount) for an extension of the deadline to file its responses to information requests. In addition, due to a scheduling conflict the Board must reschedule the commencement date of the hearing. Therefore, the Board has rescheduled the hearing to commence on Monday, December 15, 2008, at the hour of 1:00 p.m. at the ERCB’s offices, 640 - 5th Avenue SW, Calgary, Alberta. All interveners to this proceeding must be present at the commencement of the hearing to register their appearance.

Nature of the Applications
The applications before the Board are:

  • Application No. 1494136 by Paramount for approval of an experimental scheme for Class III gas injection and underground storage in the Corner McMurray C Pool.
  • Application No. 1580112 by Paramount for a review and variance of Decision 2005-122 and Shut-In Order 05-001 to allow gas production from the Corner McMurray C Pool.

Schedule for Filing Submissions
The Board has deferred the remaining filing deadlines for this hearing to the following dates:

September 25, 2008 - Response by Paramount to information requests
October 9, 2008 - Submissions by interveners and interested parties
October 23, 2008 - Information requests to interveners and interested parties
November 6, 2008 - Responses by interveners and interested parties to information requests
November 20, 2008  - Reply evidence by Paramount.

The applicant should send one copy of its response to information requests and reply submission to any interveners and interested parties who have filed information requests and/or submissions, and one electronic copy on CD in PDF format and fifteen paper copies to the ERCB. The applicant should send its information requests to any interveners and interested parties who have filed submissions, with a copy to the ERCB.

Interveners and interested parties should send one copy of their submissions and responses to information requests to the applicant and other interveners and interested parties, and one electronic copy on CD in PDF format and fifteen paper copies to the ERCB.

Notes
Any submissions filed by interveners shall contain the following:

(a) a concise statement indicating

(i) the manner in which the intervener’s rights may be directly and adversely affected by a decision of the Board on the proceeding,

(ii) the nature and scope of the intervener’s intended participation,

(iii) the disposition of the proceeding that the intervener advocates, if any,

(iv) the facts the intervener proposes to show in evidence,

(v) the reasons why the intervener believes the Board should decide in the manner that the intervener advocates, and

(vi) the intervener’s efforts, if any, to resolve issues associated with the proceeding directly with the applicant;

(b) the name, address in Alberta, telephone number, fax number and, if available, e-mail address of the intervener;

(c) if the intervener is represented by a representative, the name, address in Alberta, telephone number, fax number and, if available, e-mail address of the representative; and

(d) if the intervener is an unincorporated organization, the nature of the intervener’s membership.

If you have an interest in this matter, you are required to make a submission with respect to these applications even if you have previously filed a submission with the Board or with Paramount on these applications.

Submissions relating exclusively to compensation for land usage are not dealt with by the ERCB but may be referred to the Alberta Surface Rights Board.

In accordance with Section 13 of the Energy Resources Conservation Board Rules of Practice, all documents filed in respect of this proceeding must be placed on the public record. However, any party may make an application to the Board for confidentiality pursuant to Section 13(2) and serve a copy of such request on the other parties involved in the hearing. The Board may grant a request for confidentiality on any terms it considers appropriate, subject to the Freedom of Information and Protection of Privacy Act.

In accordance with Section 25 of the Energy Resources Conservation Board Rules of Practice, a person who intends to raise a question of constitutional law before the Board must give notice in accordance with Section 12 of the Administrative Procedures and Jurisdiction Act and its regulation.

In accordance with Section 40 of the Energy Resources Conservation Board Rules of Practice, witnesses must give evidence under oath or affirmation.
