NOTICE OF RESCHEDULING OF HEARING
APPLICATIONS NO. 1494136 AND 1580112
PARAMOUNT ENERGY OPERATING CORPORATION
CORNER MCMURRAY C POOL
ATHABASCA OIL SANDS AREA

The Energy Resources Conservation Board (ERCB/Board) will hold a public hearing of Applications No. 1494136 and 1580112 at the ERCB's offices, 640-5th Ave S.W., Calgary Alberta, commencing on March 16, 2009 , at 1:30 p.m. All interveners to this proceeding must be present at the commencement of the hearing to register their appearance.

The ERCB had scheduled a public hearing of Applications No. 1494136 and 1580112 at the ERCB's offices, 640-5th Ave S.W., Calgary, Alberta, commencing on December 15, 2008, at 1:00 pm. The Board received a request from interested parties to reschedule the hearing and agreed to grant the request.

Description of the Applications
The applications before the Board are

  • Application No. 1494136 by Paramount for approval of an experimental scheme for Class III gas injection and underground storage in the Corner McMurray C pool.
  • Application No. 1580112 by Paramount for a review and variance of Decision 2005-122 and Shut-in Order 05-001 to allow gas production from the Corner McMurray C pool.

Schedule for Filing Submissions
The Board has deferred the remaining filing deadlines for this hearing to the following dates:

January 22, 2009 Information requests to interveners and interested parties
February 5, 2009 Responses by interveners and interested parties to information requests
February 19, 2009 Reply evidence by Paramount

Interveners and interested parties should send one copy of their submissions and responses to information requests to the applicant and other interveners and interested parties, and one electronic copy on CD in PDF format and fifteen paper copies to the ERCB.

The applicant should send its information requests to any interveners and interested parties who have filed submissions, with a copy to the ERCB. Requirement to File a Submission
If you have an interest in this matter, you are required to make a submission with respect to this application even if you have previously filed a submission with the Board or with Paramount Energy Operating Corporation on this application.

If no submissions are received, the hearing in this matter may be cancelled and the ERCB will continue to process and may approve the application without further notice or without a hearing.

Contents of a Submission
Under Section 24(2) of the Energy Resources Conservation Board Rules of Practice (Rules of Practice), any submission filed must contain the following:
(a) a concise statement indicating

(i) the manner in which the intervener's rights may be directly and adversely affected by a decision of the Board on the proceeding,
(ii) the nature and scope of the intervener's intended participation,
(iii) the disposition of the proceeding that the intervener advocates, if any,
(iv) the facts the intervener proposes to show in evidence,
(v) the reasons why the intervener believes the Board should decide in the manner that the intervener advocates, and
(vi) the intervener's efforts, if any, to resolve issues associated with the proceeding directly with the applicant;

(b) the name, address in Alberta, telephone number, fax number and, if available, e-mail address of the intervener;
(c) if the intervener is represented by a representative, the name, address in Alberta, telephone number, fax number and, if available, e-mail address of the representative; and
(d) if the intervener is an unincorporated organization, the nature of the intervener's membership.

Compensation Issues
Submissions relating exclusively to compensation for land usage are not dealt with by the ERCB but may be referred to the Alberta Surface Rights Board.

Applications for Confidentiality
In accordance with Section 13 of the Rules of Practice, all documents filed in respect of this proceeding must be placed on the public record. However, any party may make an application to the Board under Section 13(2) for confidentiality and serve a copy of such request on the other parties involved in the hearing. The Board may grant a request for confidentiality on any terms it considers appropriate, subject to the Freedom of Information and Protection of Privacy Act.

Questions of Constitutional Law
In accordance with Section 25 of the Rules of Practice, a person who intends to raise a question of constitutional law before the Board must give notice in accordance with Section 12 of the Administrative Procedures and Jurisdiction Act and its regulation.
