The Energy Resources Conservation Board (ERCB/Board) will hold a public hearing of Applications No. 1613543, 1616123, and 1506272 (Applications) at the ERCB Head Office, 640 – 5 Avenue SW, Calgary, Alberta, commencing November 23, 2010, at 9:00 a.m. All participants to this hearing must be present at the commencement of the hearing to register their appearance.

The ERCB had scheduled a public hearing of the Applications at the ERCB Head Office, 640 – 5 Avenue SW, Calgary, Alberta, commencing on January 18, 2010, at 9:00 a.m. With the agreement of all parties, the Board has revised the filing schedule and the commencement date of the hearing in order to accommodate the filing of additional information.

Description of the Applications

Application No. 1613543
Sunshine Oilsands Ltd. (Sunshine) has applied, pursuant to Section 3(5) of the Oil Sands Conservation Regulation (OSCR), to shut in gas production from 104 wells within and around the Liege Wabiskaw O Pool.

Application No. 1616123
Total E&P Canada Ltd. has applied, pursuant to Section 3(5) of the OSCR, to include the well at Legal Subdivision 6, Section 4, Township 94, Range 17, West of the 4th Meridian, (00/06-04-094-17W4 well) within Sunshine's region of influence.

Application No. 1506272
Paramount Energy Operating Corporation has applied to produce gas from the Wabiskaw zone at the 02/01-28-093-18W4 well.

Nature of the Hearing
On October 15, 2009, the Board issued Decision 2009-061: Sunshine Oil Sands Ltd. and Total E&P Canada Ltd., Applications for Interim Shut-in of Gas, Liege Field, Athabasca Oil Sands Area, which required 228 intervals in 158 wells to be shut in on an interim basis. On January 11, 2010, after reviewing a clarification request by Canadian Natural Resources Limited, the Board added 16 intervals to the shut-in list. This hearing will consider the production status of these intervals. The intervals are listed in an appendix, which consists of Tables 1 and 2 of the amended Interim Shut-in Order issued January 11, 2010, and posted along with this notice on the ERCB Web site www.ercb.ca.

Requirement to File a Submission
If you have an interest in this matter and wish to make submissions or submit evidence to the hearing of the Applications, you must file submissions with respect to these Applications even if you have previously filed a submission with the Board or with the applicants on these Applications. Submissions must include copies of all documentary evidence that you intend to present and/or rely on at the hearing (including, but not limited to, copies of expert reports) and a summary of all evidence you intend to present and/or rely on.

If no submissions opposing the Applications are filed, the hearing of the Applications may be cancelled and the ERCB will continue to process and may approve the Applications without a hearing and without further notice.

Contents of Submissions
The contents of submissions filed must comply with the Energy Resources Conservation Board Rules of Practice ( Rules of Practice ).

Applications for Confidentiality
In accordance with Section 13 of the Rules of Practice, all documents filed in respect of this proceeding must be placed on the public record. However, any party may make an application to the Board under Section 13(2) for confidentiality and serve a copy of such request on the other parties involved in the hearing. The Board may grant a request for confidentiality on any terms it considers appropriate, subject to the Freedom of Information and Protection of Privacy Act.

Questions of Constitutional Law
Under Section 25 of the Rules of Practice, a person who intends to raise a question of constitutional law before the Board must give notice in accordance with Section 12 of the Administrative Procedures and Jurisdiction Act and its regulation.
