Take Notice that Cardinal River Coals Ltd. (CRC) has applied to the Alberta Energy and Utilities Board (EUB) and Alberta Environment (AENV) for approval to develop a Private Haul Road from the Cheviot Mine site to the Coal Processing Plant located at the Luscar Mine site. The Private Haul Road, which would consist of the new private coal haul road and alignment modifications to the existing Grave Flats Road (public road), would provide CRC with another option to develop coal reserves at the Cheviot Mine. The coal at Cheviot would be hauled to the Luscar Mine for processing at the existing coal processing plant. The project is located approximately 300 km west of Edmonton and 70 km south of Hinton within the County of Yellowhead #94. The Luscar Mine is located within Townships 47 and 48, Ranges 24 and 25 and the Cheviot Mine is located within Townships 45 and 46, Ranges 21, 22, 23 and 24.

This Notice of Filing is being distributed to advise interested persons that the applications are available, and that the EUB, AENV and other government departments are now undertaking reviews of the applications.

Nature of the Applications

In support of their proposal, CRC has prepared and submitted the following applications:

         Application No. 1276297 to the EUB, pursuant to Section 13 of the Coal Conservation Act, to amend (extend) the Cheviot Mine Permit No. 2000-37 and the Luscar Mine Permit No.

C 2000-2 to include the area described as the private Haul Road.

         Combined Application No. 026-11767 and No. 003-46972 to AENV, under the Environmental Protection and Enhancement Act (EPEA), for approval to construct, operate and reclaim a private haul road between the previously approved Luscar Mine and Cheviot Mine.

         Application No. 00188589 to AENV, under the Water Act (WA), for an amendment to Permit 98-44-NES authorizing construction of crossings along the private haul road corridor, comprising of:

-          Two major stream crossings, on Whitehorse Creek in NE 24-46-24-W5 and on Prospect Creek in NE 18-46-23-W5;

-      13 ephemeral stream culvert crossings approximately located at:
