Take Notice that the Alberta Energy and Utilities Board (EUB/Board) will hold a public hearing of Application No. 1378400 at the offices of the Board, 640 – 5 Avenue SW, Calgary, Alberta, commencing on Wednesday, August 17, 2005, at the hour of 9:00 a.m. All interveners to this proceeding must be present at the commencement of the hearing to register their appearance.
Nature of the Application
Avenir Diversified Income Trust (Avenir) (formerly Val Vista Energy Ltd.) applied
- under section 48(1) of the Oil and Gas Conservation Act (the Act) for an order declaring Dynegy Canada Inc. as a common carrier of gas from a portion of the Taber Second White Specks B Pool, through a pipeline extending from Legal Subdivision 10 of Section 14, Township 9, Range 14, West of the 4th Meridian W4M to a location in Legal Subdivision 6 of Section 29, Township 9, Range 14, West of the 4th Meridian;
- under section 48(4)(a) of the Act for the EUB to designate the existing tie in points for the gas to be transported as the points at which the common carrier shall take delivery of the gas to be transported under the common carrier order;
- under section 55(1) of the Act for the EUB to set the transportation fee to be paid for the gas to be taken by the common carrier; and
- under section 56 of the Act for the above noted orders to be effective as of January 1, 2005.

Any submission filed shall contain the following:
(a) a concise statement indicating
(i) the manner in which the intervener's rights may be directly and adversely affected by a decision of the Board on the proceeding,
(ii) the nature and scope of the intervener's intended participation,
