Take Notice that Deer Creek Energy Limited (DCEL) has applied to the Alberta Energy and Utilities Board (EUB) and Alberta Environment (AENV) for approval to construct, operate, and reclaim the proposed Joslyn SAGD Project - Phase IIIA (Project) located in Townships 94-96, Ranges 11-13, West of the 4th Meridian (W4M), approximately 70 kilometres north of Fort McMurray. The Project will add 15 000 barrels per day of bitumen (2385 cubic metres per day) increasing the combined SAGD production to 27 000 barrels per day (4295 cubic metres per day) for the overall project. The Project will utilize a steam assisted gravity drainage (SAGD) process to extract the resource. The proposed Project would include:

  • An incremental increase of 54.8 ha of disturbance,

  • A central processing facility, six well pads (approximately 28 well pairs), borrow pits and an access corridor,

  • Distribution and gathering pipelines, and

  • An additional storm water retention pond.

Nature of the Application

  • Application No. 1389383 to the EUB under Section 10 of the Oil Sands Conservation Act to authorize the proposed Project. DCEL has also prepared an Environmental Impact Assessment (EIA) report to the Director of Environmental Assessment, Northern Region. The EIA report forms part of the application to the EUB.

  • Application No. 004-147283 to AENV under the Environmental Protection and Enhancement Act (EPEA) for construction, operation, and reclamation of the Project.

  • An application (File 00198976) under Sections 37 and 50 of the Water Act, to authorize water management plans, for industrial purposes, including:

- the diversion of up to 192 975 cubic metres of surface water annually from:

- the Athabasca River at NE Quarter, Section 26, Township 095, Range 11, W4M with a maximum diversion rate of 0.03 cubic metres per second, and

- a stormwater collection pond at NW Quarter, Section 28, Township 95, Range 12, W4M; and

- storm drainage works that include a stormwater collection pond at NW Quarter, Section 28, Township 95, Range 12, W4M .

To File a Statement of Concern

Statements of concern under EPEA or the Water Act must be submitted by May 20, 2005. Please quote Application No. 004-147283 (EPEA) or File No. 00198976 (Water Act) when submitting a statement of concern. If no statements of concern are received, the EPEA and Water Act Application may be approved without further notice. Failure to file a statement of concern may affect the right to file a Notice of Appeal with the Environmental Appeal Board. Note that any statements filed regarding these applications will become part of the public record, and will be accessible to the public.

To File an EUB Submission

If you have an interest in this application and you wish to file a submission, please state in writing your reasons for filing. (Note: there will be a second opportunity at a later date to file a submission with the EUB). Send one copy of your submission to the DCEL contact at the name and address above and another copy to:

Notes

Any submission filed shall contain the following:

(a) a concise statement indicating

(i) the manner in which the intervener's rights may be directly and adversely affected by a decision of the Board on the proceeding,

(ii) the nature and scope of the intervener's intended participation,

(iii) the disposition of the proceeding that the intervener advocates, if any,

(iv) the facts the intervener proposes to show in evidence,

(v) the reasons why the intervener believes the Board should decide in the manner that the intervener advocates, and

(vi) the intervener's efforts, if any, to resolve issues associated with the proceeding directly with the applicant;

(b)  the name, address in Alberta, telephone number, fax number and, if available,
