THE STONEFELL PIPELINE FROM THE STONEFELL TERMINAL TO AN ENBRIDGE ATHABASCA LEASE ADJACENT TO THE ENBRIDGE EDMONTON TERMINAL AND TWO LATERAL PIPELINES BETWEEN THE STONEFELL TERMINAL AND THE INTER PIPELINE FUND (IPF) SYSTEM

Take Notice that the Alberta Energy and Utilities Board (EUB/Board) will hold a public hearing of Applications No. 1460029 and 1450418 at the Alberta Energy and Utilities Board, 12th Floor Hearing Room, HSBC Building, 10055 – 106 Street, Edmonton, Alberta, commencing on Tuesday, February 20, 2007, at the hour of 1:00 p.m. All interveners to this proceeding must be present at the commencement of the hearing to register their appearance.

Nature of the Applications
Enbridge Pipelines (Athabasca) Inc.  has applied pursuant to Part 4 of the Pipeline Act for approval to construct and operate four pipelines and three pump stations.
 The Waupisoo Pipeline Project (Application No. 1460029) is proposed to transport crude oil from Enbridge Athabasca’s existing Cheecham Terminal located in Legal Subdivision (LSD) 6, Section 8, Township 84, Range 6, West of the 4th Meridian, to an Enbridge Athabasca lease adjacent to the Enbridge Edmonton Terminal located in LSD 7, Section 5, Township 53, Range 23, West of the 4th Meridian. The transportation would be powered by three pump stations located along the pipeline right-of-way at LSD 6, Section 8, Township 84, Range 6, West of the 4th Meridian (Cheecham pump station), LSD 12, Section 22, Township 68, Range 17, West of the 4th Meridian (Mid-Point pump station), and LSD 1, Section 9, Township 56, Range 21, West of the 4th Meridian (Bruderheim pump station located within the Stonefell Terminal). The proposed Waupisoo pipeline would be about 380 kilometres (km) in length, with an outside diameter (OD) of 762 millimetres (mm).

The Stonefell Pipelines Project (Application No. 1450418) are proposed to transport crude oil feedstock and upgraded crude oil product to and from BA Energy’s Heartland Upgrader Project. The proposed Stonefell/IPF Crude Oil Lateral would transport blended crude oil through a 7.5 km long, 610 mm OD pipeline from an interconnection with the IPF pipeline system at LSD 9, Section 6, Township 56, Range 20, West of the 4th Meridian, to the Stonefell Terminal at LSD 1, Section 9, Township 56, Range 21, West of the 4th Meridian. The proposed Stonefell/IPF Diluent Lateral would transport diluent through a 7.5 km, 324 mm OD pipeline from the Stonefell Terminal (1-9) to an interconnection with IPF (9-6). The proposed Stonefell/Edmonton pipeline would transport upgraded crude oil through a 46 km long, 610 mm OD pipeline from the Stonefell Terminal (1-9) to an Enbridge Athabasca lease adjacent to the Enbridge Edmonton Terminal at LSD 7, Section 5, Township 53, Range 23, West of the 4th Meridian. This pipeline would run parallel to the (approved) Access and (pending) Waupisoo pipeline rights-of-way. A portion would also be located within the Transportation and Utility Corridor (TUC).

Any person intending to make a submission with respect to the hearing of Applications No. 1460029 and 1450418 shall file on or before 4:00 p.m., Monday, February 5, 2007. Send one copy of your submission to the applicant at the name and address above and ten copies to:

Notes
Any submission filed shall contain the following:

(a) A concise statement indicating
  
     (i) the manner in which the intervener’s rights may be directly and adversely affected by a decision of the Board on the proceeding,

     (ii) the nature and scope of the intervener’s intended participation,

     (iii) the disposition of the proceeding that the intervener advocates, if any,

     (iv) the facts the intervener proposes to show in evidence,

     (v) the reasons why the intervener believes the Board should decide in the manner that the intervener advocates, and

     (vi) the intervener’s efforts, if any, to resolve issues associated with the proceeding directly with the applicant;


(b) the name, address in Alberta, telephone number, fax number and, if available, e-mail address of the intervener;

(c) if the intervener is represented by a representative, the name, address in Alberta, telephone number, fax number and, if available, e-mail address of the representative; and

(d) if the intervener is an unincorporated organization, the nature of the intervener’s membership.

If you have an interest in this matter, you are required to make a submission with respect to this application even if you have previously filed a submission with the Board or with Enbridge Pipelines (Athabasca) Ltd. on these applications.

If there are no submissions received, this hearing may be cancelled and the EUB will continue to process the application without further notice or without a hearing.

Submissions relating exclusively to compensation for land usage are not dealt with by the EUB but may be referred to the Alberta Surface Rights Board.

In accordance with Section 12 of the Alberta Energy and Utilities Board Rules of Practice, all documents filed in respect of this proceeding must be placed on the public record unless otherwise ordered by the Board.

In accordance with Section 23.1 of the Alberta Energy and Utilities Board Rules of Practice, a person who intends to raise a question of constitutional law before the Board must give notice in accordance with Section 12 of the Administrative Procedures and Jurisdiction Act and its regulation.

In accordance with Section 38 of the Alberta Energy and Utilities Board Rules of Practice, witnesses must give evidence under oath or affirmation.
