The Alberta Energy and Utilities Board (EUB/Board) scheduled a public hearing of Applications No. 1475827 and 1497233 at the offices of the Board, 640 - 5 Avenue SW, Calgary, Alberta, commencing on Tuesday, May 29, 2007, at 9:00 a.m. A request was made by an interested party to reschedule the hearing and the Board decided to grant this request.
Take Notice that the Alberta Energy and Utilities Board (EUB/Board) will hold a public hearing of Applications No. 1475827 and 1497233 at the offices of the EUB, 640 - 5 Avenue SW, Calgary, Alberta, commencing on Tuesday, July 24, 2007, at the hour of 9:00 a.m. All interveners to this proceeding must be present at the commencement of the hearing to register their appearance.
Nature of the Applications
Application No. 1475827
Montane Resources Ltd. (Montane) has filed Application No. 1475827 which consists of the following applications: compulsory pooling, common carrier, and common processor. The particulars of these applications are set out in the paragraphs below.
1. Compulsory Pooling Application. Montane has applied pursuant to section 80 of the Oil and Gas Conservation Act (OGCA) for an order prescribing that all tracts within Sections 31 and 32-51-9W4 be operated as a unit for the production of gas from Viking zone, through a well with unique identifier of 9-31-51-9W4M (9-31 well). Montane has requested, among other things, that costs and revenues be allocated on a tract area basis, and that it be appointed the operator of the 9-31 well. Additionally, Montane has applied under section 80 (4)(d) of the OGCA, that the pooling order provide for the equalization of the actual costs of drilling and completing the 9-31 well having regard for the date of such costs and the cumulative production from the pooled production zone before and after Montane's date of ownership.
2. Common Carrier Application. Montane has applied under section 48 (1) of the OGCA for an order declaring Dominion as a common carrier of gas from the Mannville Upper and Middle Viking B Pool (Viking B Pool), through a pipeline extending from LSD 9-31-51-9 W4M to the gas gathering system located at LSD 8-24-51-10 W4M (the 8-24 GGS). Montane has also applied under section 48 (4)(a) of the OGCA for the EUB to designate the 9-31-51-9W4 (9-31) and 7-30-51-9W4 (7-30) tie in location as the point at which the common carrier shall take delivery of the gas to be transported under common carrier order.
3. Common Processor Application. Montane has applied under the following statutory provisions:
- section 53 (1) of the OGCA for an order declaring Dominion as a common processor of gas produced from the Viking B Pool through the 8-24 GGS;
- section 53(5)(b) of the OGCA that the common processor order directs Dominion to process up to 20 103m3/d of Montane's production; and
- section 56 of the OGCA for the common carrier and common processor orders to be retroactive to the date when Montane's production from the 9-31 well would be first affected, January 13, 2005.

Application No. 1497233
Dominion has applied pursuant to section 4.020 of the Oil and Gas Conservation Regulations (OGCR) to amend the drilling spacing unit (DSU) from two sections to one section for the production of gas from the Viking Formation for Sections 31 and 32-51-9W4M. Dominion proposes the standard conditions for the DSUs in accordance with sections 4.021 and 4.030 of the OGCR.

Any submission filed shall contain the following:
(a) a concise statement indicating
(i) the manner in which the intervener's rights may be directly and adversely affected by a decision of the Board on the proceeding,

In accordance with Section 23.1 of the Alberta Energy and Utilities Board Rules of Practice, a person who intends to raise a question of constitutional law before the Board must give notice in accordance with section 12 of the Administrative Procedures and Jurisdiction Act and its regulation.
Submissions relating exclusively to compensation for land usage are not dealt with by the EUB, but may be referred to the Alberta Surface Rights Board.
