NOTICE OF REOPENING OF HEARING

The Energy Resources Conservation Board (ERCB/Board) held a public hearing of Application No. 1523329 at the ERCB’s offices in Calgary, Alberta, starting on Monday, December 1, 2008. On March 3, 2009, the Board requested that additional information be filed by the Applicant and Interveners by March 30, 2009. The Board has now received the additional submissions from parties and finds that it is in the public interest to reopen the hearing for the limited purpose of providing the parties with the opportunity to provide oral evidence and argument with respect to the additional submissions that were filed.
The ERCB will reopen the public hearing of Application No. 1523329 at the ERCB’s offices, 640 - 5 Avenue S.W., Calgary, Alberta, commencing on Tuesday, April 14, 2009, at 9:00 a.m. All interveners to this proceeding must be present at the commencement of the hearing to register their appearance.
Description of the Application
Nexxtep Resources Ltd. (Nexxtep) submitted an application, pursuant to Section 33(1) (d) of the Oil and Gas Conservation Act (OGCA) to redesignate the Wilson Lower Mannville C pool (0973 0310003 000) to a Rock Creek pool. Consequential measures, in accordance with Sections 16 and 25 of the OGCA, and such other or alternative relief as the ERCB may deem appropriate, are also requested.

Applications for Confidentiality
In accordance with Section 13 of the Rules of Practice, all documents filed in respect of this proceeding must be placed on the public record. However, any party may apply for confidentiality of information under Section 13(2). Any application under Section 13(2) that is to be considered during a public hearing of the application must be copied to the other parties to the proceeding. The Board may grant a request for confidentiality on any terms it considers appropriate, subject to the Freedom of Information and Protection of Privacy Act.
Questions of Constitutional Law
In accordance with Section 25 of the Rules of Practice, a person who intends to raise a question of constitutional law before the Board must give notice in accordance with Section 12 of the Administrative Procedures and Jurisdiction Act and its regulation.
