EUB DENIES COMPTON REQUEST FOR EXTENSION TO ITS EMERGENCY RESPONSE PLAN DEADLINE

Calgary, Alberta (December 21, 2005) The Alberta Energy and Utilities Board (EUB) today denied Compton Petroleum Corporation’s request to extend the deadline for submission of its Emergency Response Plan (ERP) from January 1, 2006 to September 1, 2006.

Compton submitted the request to the EUB on December 15, 2005, citing reticence from the City of Calgary and Calgary Health Region (CHR) to collaboratively develop the ERP, plus uncertainty due to pending reviews and appeals filed by the City and the CHR regarding EUB Decision 2005-060.

The EUB has decided not to grant Compton’s extension for the following reasons:

  • On August 15, 2005, the EUB granted an extension from the original November 1, 2005 deadline to a revised deadline of January 1, 2006.

  • The extension requested by Compton for the filing of its ERP would have the effect of significantly delaying the process for finalization of the ERP.

  • Compton has not demonstrated to the EUB’s satisfaction that it had completed all tasks that did not require cooperation with other groups.

  • Compton has not demonstrated to the EUB’s satisfaction that it has explored all possible opportunities to work with the various parties.

  • Compton has not demonstrated to the EUB’s satisfaction that it was prevented from meeting the deadline as the result of circumstances beyond its control.

The EUB circulated the request to interveners from the original hearing for their input prior to making its ruling on this matter. Most of the parties that responded opposed the extension.

Compton’s draft ERP is to be filed by the close of business Tuesday, January 3, 2006 (due to the New Year Holiday). Once received, the EUB will follow the process set out in its November 28, 2005 correspondence and today’s letter. Any deficiencies in the filed ERP will be dealt with in that process.

The EUB will regard Compton’s failure to file a draft ERP by January 3, 2006 as an abandonment of Compton’s applications and the EUB will close the file.
