APPLICATION NO. 1360900

OTTER FIELD

Take Notice that the Alberta Energy and Utilities Board (EUB/Board) will hold a public hearing of Application No. 1360900 at the Sandman Hotel, 888 7 Avenue SW, Calgary, Alberta, commencing on Thursday, January 20, 2005, at the hour of 9:00 a.m. All interveners to this proceeding must be present at the commencement of the hearing to register their appearance.

Nature of the Application

Celtic Exploration Ltd. applied

  • under section 48(1) of the Oil and Gas Conservation Act (the Act) for an order declaring Tempest Energy Corp. (Tempest) as a common carrier of gas from an undefined Banff pool in the Otter Field (the subject pool), through a pipeline extending from a tie in point at Legal Subdivision 2 of Section 22, Township 88, Range 12, West of the 5th Meridian (Lsd 2-22-88-12 W5M) to the Tempest Red Earth gas plant located in Lsd 2-23-88-8 W5M (the Red Earth gas plant), including a compressor at Lsd 15-15-88-12 W5M;

  • under section 53(1) of the Act for an order declaring Tempest to be a common processor of gas produced from the subject pool through the Red Earth gas plant;

  • under sections 48(4)(b) and 53(5)(a) of the Act for the EUB to allocate the proportion of production to be taken by the common carrier and common processor from the subject pool;

  • under section 56 of the Act for the above noted orders to be effective as of the date of the application, September 14, 2004.

The Board has established the following filing deadlines for this hearing:

January 12, 2005 Final date for submissions by any parties having concerns respecting any of the applications.

January 17, 2005 Final date for any response from the applicant to the submissions filed by concerned parties.

Notes

Any submission filed shall contain the following:

(a) a concise statement indicating

(i) the manner in which the intervener's rights may be directly and adversely affected by a decision of the Board on the proceeding,

(ii) the nature and scope of the intervener's intended participation,

(iii) the disposition of the proceeding that the intervener advocates, if any,

(iv) the facts the intervener proposes to show in evidence,

(v) the reasons why the intervener believes the Board should decide in the manner that the intervener advocates, and

(vi) the intervener's efforts, if any, to resolve issues associated with the proceeding directly with the applicant;

If there are no submissions received, this hearing may be cancelled and the EUB will continue to process the application without further notice or without a hearing.

In accordance with Section 38 of the Alberta Energy and Utilities Board Rules of Practice, witnesses must give evidence under oath or affirmation.

Submissions relating exclusively to compensation for land usage are not dealt with by the EUB but may be referred to the Alberta Surface Rights Board.

Any statements filed regarding this application become part of the public record and are accessible by the public.
