Take Notice that Imperial Oil Resources Ventures Limited (Imperial Oil) and ExxonMobil Canada Properties (ExxonMobil Canada) have made application to the Alberta Energy and Utilities Board (EUB) and Alberta Environment (AENV) for approval of the proposed Kearl Oil Sands Project Mine Development (Kearl Project). 
 
The proposed project consists of four mine pits to be mined over the period 2010 to 2060 by truck and shovel, three trains of ore preparation and bitumen production facilities, a cogeneration plant consisting of three 85-megawatt gas turbine generators, one for each production train, one external tailings area for all three trains, and other related infrastructure to support the operation (water intake, water pipeline, water storage, construction and operations camps, roads and an airstrip). Filing of the EUB application for the cogeneration plant is pending. The expected production capability from all three trains will be 300,000 barrels (approximately 48,000 cubic metres) per calendar day of partially deasphalted bitumen (clean bitumen). The application seeks approval for a maximum production capacity of approximately 345,000 barrels (55,000 cubic metres) per calendar day of clean bitumen.
 
The leases included in the Kearl Project are located approximately 70 kilometers north of Fort McMurray and are located within Township (Twp) 95, Range (Rge) 7 and 8, Twp 96, Rge 6, 7, and 8, Twp 97, Rge 6, 7, and 8, Twp 98, Rge 10, and Twp 99, Rge 10.
Construction of the proposed project, if approved, could begin in early 2007.
 
This Notice of Application is being distributed to advise interested persons that the applications are available, and that the EUB, AENV and other government departments are now undertaking reviews of the applications.

Nature of the Application
In support of the proposal, Imperial Oil has prepared and submitted the following applications:
  • Application No. 1408771 to the EUB,
    • Pursuant to Section 10 and 11 of the Oil Sands Conservation Act (OSCA) and Sections 3, 24, 26, and 48 of the Oil Sands Conservation Regulation (OSCR), for approval for the mining, lease development, on-site waste management and reclamation activities and for approval of an oil sands processing plant for the recovery of bitumen and processing of recovered bitumen froth.
  • Application No. 001-46586 to AENV,
    • Pursuant to the Environmental Protection and Enhancement Act (EPEA) for construction, operation and reclamation of the Kearl Oil Sands Project.
  • Application No. 001-00222199 to AENV,
    • Pursuant to Sections 36 and 50 of the Water Act, for diversion and impoundment of surface water and groundwater as well as water allocation from the Athabasca River
    • The maximum annual diversion from the Athabasca River will be 104,000,000 cubic metres
    • The maximum annual groundwater diversion will be 9,000,000 cubic metres.
    • The maximum annual surface water diversion will be 52,000,000 cubic metres.
These applications share a common Environmental Impact Assessment (EIA) report which Imperial Oil has prepared and submitted to the Director, Environmental Assessment, Northern Region. The EIA report forms part of the applications to the EUB.

To File a Statement of Concern
 
Further Take Notice under Section 73 of EPEA and Section 109 of the Water Act, any person who is directly affected by the EPEA Application or the Water Act Application may submit a written statement of concern. Statements of concern under EPEA and the Water Act must be submitted by October 31, 2005. Failure to file a statement of concern may affect the right to file a Notice of Objection (on appeal) with the Environmental Appeal Board. Please quote Application No. 001-46586 (EPEA) or Application No. 001-00222199 (Water Act) when submitting a statement of concern. If no statements of concern are received, the EPEA and Water Act Applications may be approved without further notice. Please submit your statement to:
