ERCB ACCEPTS WEST ENERGY REQUEST TO WITHDRAW TWO APPLICATIONS

Calgary, Alberta (September 2, 2008) The Energy Resources Conservation Board (ERCB) has accepted a request from West Energy Ltd. to withdraw two applications to drill two sour crude oil wells near Rocky Rapids, Alberta. These applications were reviewed by the ERCB in March 2006 and were the subject of two public hearings held in May 2007 and January 2008.

On August 8, 2007 the ERCB issued Decision 2007-061, which conditionally approved West’s applications to drill two sour crude oil wells. One of the conditions of approval was that a new egress road must be constructed prior to drilling the first well. The company subsequently proposed a different route for the egress road.

Given the change in circumstances and concerns expressed by interveners regarding the proposed change, the ERCB initiated a review hearing to consider the proposal. In May 2008, the ERCB issued Decision 2008-040, which stated that Decision 2007-061 must remain unchanged and directed West to meet its commitment and condition in regarding the original road.

On August 14, 2008, West notified the ERCB that it was withdrawing its applications as it could not fulfill the condition to construct a second egress road. West indicated that a feasibility study had determined that the road was not technically or economically feasible.

West may reapply in the future without prejudice. Any future applications will be considered by the ERCB on their own merits.
