ERCB ISSUES SECTION 106 DECLARATIONS NAMING TWO OIL EXECUTIVES

Calgary, Alberta (December 20, 2011) In  Decision 2011 ABERCB 037, the Energy Resources Conservation Board (ERCB) has issued Declarations which name Marc R. Dame and Murray F. Craig under Section 106 of the Oil and Gas Conservation Act (OGCA) after a process that included a public hearing.

The ERCB has the authority under the OGCA to issue a declaration naming persons (directors, officers, agents or other persons) in control of licensees, approval holders or working interest participants that have failed to comply with Board Orders, or which have outstanding debts to the ERCB, or to the Orphan Fund with respect to incurred suspension, abandonment, and reclamation costs.

The ERCB has determined that Dame and Craig were persons in direct or indirect control of Legacy Petroleum Ltd. when it contravened ERCB requirements and failed to comply with Board Orders. The ERCB has also determined that Dame was a person in direct control of Matrix Resources Ltd. when it contravened ERCB requirements and failed to comply with Board Orders.

As a result, the ERCB has issued declarations under Section 106 of the OGCA naming Dame and Craig as outlined in Decision 2011 ABERCB 037.

The declarations carry with them a number of restrictions, including:

  • The ERCB may refuse to consider any application from Dame or Craig, or any company over which Dame or Craig, in the opinion of the ERCB, is a director, officer, agent or other person in direct or indirect control, for an identification code, licence, or approval or a transfer of a licence or approval under the OGCA or the Pipeline Act.
     
  • The ERCB may suspend operations of a licensee or approval holder under the OGCA or a licensee under the Pipeline Act over which Dame or Craig, in the opinion of the ERCB, is a director, officer, agent or other person in direct or indirect control.

The declarations are in force immediately and will remain in force against Dame until December 31, 2019 and against Craig until December 31, 2016.
