Take Notice that BA Energy Inc. has applied to the Alberta Energy and Utilities Board (EUB) and Alberta Environment (AENV) for approval to construct and operate an 41 400 m3/stream day upgrader and associated infrastructure in Strathcona County near Fort Saskatchewan, Alberta (south half of Section 10, Township 56, Range 21, West of the 4th Meridian). The upgrader is proposed to be developed in three equal phases with the first phase scheduled for completion by late 2006.
This Notice of Application is being distributed to advise interested persons that the applications are available, and that the EUB, AENV and other government departments are now undertaking reviews of the applications.
In support of their proposal, BA Energy Inc. has prepared and submitted the following applications:
- Application No. 1347899 to the EUB, pursuant to Section 11 of the Oil Sands Conservation Act. In support of its proposal and as part of this application to the EUB, BA Energy Inc. has also submitted an Environmental Impact Assessment (EIA) report to AENV. The EIA report forms part of the application to the EUB (No. 1347899).
- Application No. 001-203303 to AENV, pursuant to Section 64 of EPEA, to construct and operate an 41,400 m3/stream day upgrader and associated infrastructure.
- An application (File No. 00208953) to AENV, pursuant to Sections 37 of the WA, to authorize site water management plans for the construction and operation of the upgrader.
Further Take Notice that pursuant to Section 73 of the Environmental Protection and Enhancement Act (EPEA), and Section 109 of the Water Act (WA), any person who is directly affected by EPEA Application No. 001-203303 or the WA application (File No. 00208953), may submit a written statement of concern to:

Statements of concern under EPEA and WA must be submitted by August 6, 2004. Failure to file a statement of concern may affect the right to file a Notice of Objection (on appeal) with the Environmental Appeal Board. Please quote Application No. 001-203303 (EPEA) or File No. 00208953 (WA) when submitting a statement of concern. If no statements of concern are received, the EPEA and WA applications may be approved without further notice. Note that any statements filed regarding these applications are public records and are therefore accessible by the public.
