Take Notice that the Alberta Energy and Utilities Board (EUB/Board) will hold a public hearing of Proceeding No. 1487462 at the EUB Calgary Office, 640 - 5 Avenue SW, Calgary, Alberta, commencing on Thursday, April 19, 2007, at the hour of 9:00 a.m. All interveners to this proceeding must be present at the commencement of the hearing to register their appearance.
Nature of Proceeding No. 1487462
On August 23, 2006, the Board approved Application No. 1475428 and issued Facility Licence No. F36914 to Real Resources Inc. (Real). The licence permitted Real to construct and operate a multiwell oil battery, in Legal Subdivision (LSD) 16, Section 12, Township 63, Range 15, West of the 5th Meridian. On August 24, 2006, the EUB received a letter from Canetic Resources Inc. (Canetic) objecting to the EUB's issuance of Facility Licence No. F36914. Given that the subject licence had been granted, this correspondence was considered a request for review of the facility licence pursuant to Section 40 of the Energy Resources Conservation Act (ERCA). The Board considered the written submissions of the parties and conducted an oral proceeding to consider the Phase 1 review request.
By letter dated November 14, 2006, the Board approved the request to hold a review hearing into the Board's decision to grant Facility Licence No. F36914. The Board registered the review hearing as Proceeding No. 1487462. The purpose of the review hearing is to determine whether the Board should confirm, vary or rescind its decision to grant Facility Licence No. F36914.
Nature of Application No. 1475428
Real Resources Inc. (Real) applied pursuant to Section 7.001 of the Oil and Gas Conservation Regulations, for approval to construct and operate a multiwell oil battery in LSD 16-12-63-15W5M in the Sakwatamau Field. Equipment at the site consists of two oil emulsion tanks and one produced water tank, with the capacity to add two additional oil emulsion tanks and one produced water tank. The battery currently receives production from three wells and is designed to process gas associated with the oil with a maximum hydrogen sulphide content of 30.0 moles per kilomole (3.0 per cent). The battery is located approximately 43 kilometres east of the Town of Fox Creek.

Notes
Any submission filed shall contain the following:
(a) a concise statement indicating
(i) the manner in which the intervener's rights may be directly and adversely affected by a decision of the Board on the proceeding,
(ii) the nature and scope of the intervener's intended participation,
(iii) the disposition of the proceeding that the intervener advocates, if any,
(iv) the facts the intervener proposes to show in evidence,
(v) the reasons why the intervener believes the Board should decide in the manner that the intervener advocates, and

Submissions relating exclusively to compensation for land usage are not dealt with by the EUB but may be referred to the Alberta Surface Rights Board.
In accordance with Section 12 of the Alberta Energy and Utilities Board Rules of Practice, all documents filed in respect of this proceeding must be placed on the public record unless otherwise ordered by the Board.
In accordance with Section 23.1 of the Alberta Energy and Utilities Board Rules of Practice, a person who intends to raise a question of constitutional law before the Board must give notice in accordance with Section 12 of the Administrative Procedures and Jurisdiction Act and its regulation.
In accordance with Section 38 of the Alberta Energy and Utilities Board Rules of Practice, witnesses must give evidence under oath or affirmation.
