NOTICE OF RESCHEDULING OF PREHEARING MEETING

Take Notice that the Energy Resources Conservation Board (ERCB/Board) had scheduled a prehearing meeting of Application 1490956 at the Lakeview Inn & Suites, located at 10115 - 88 Avenue, in Fort Saskatchewan, Alberta, commencing on Friday, February 29, 2008, at 9:00 a.m. The Board received a request from interested parties to reschedule the prehearing meeting and it agreed to grant the request.
Therefore, Take Notice that the ERCB will hold a prehearing meeting of Application 1490956 at the Dow Centennial Centre 8700 – 84 Street, Fort Saskatchewan, Alberta, commencing on Friday, March 14, 2008, at 9:00 a.m. The matters to be considered include, but would not be limited to:
• establishing the scope and purpose of the hearing, including relevant issues to be examined,
• establishing the timing and location of the public hearing,
• identifying the procedures to be used in the hearing,
• identifying the participants and their roles in the hearing,
• discussing the funding of the participants, and
• any other matters as necessary.
This prehearing meeting is not being held to hear evidence or argument pertaining to the merits of the application or objections; it is to obtain parties’ views on the topics listed above. Parties will be given an opportunity to present evidence, cross-examine witnesses, and make arguments regarding the merits of the application at the public hearing of the application.
Nature of Application
Petro-Canada Oil Sands Inc. (PCOSI) has applied, on behalf of the Fort Hills Energy Corporation and Fort Hills Energy L.P. (Fort Hills), to the Alberta Energy and Utilities Board (EUB) and Alberta Environment (AENV) for approval to construct and operate the Fort Hills Sturgeon upgrader and associated infrastructure with a capacity to process 54,000 cubic metres per day of bitumen. The proposed upgrader would be located in Sturgeon County, approximately 40 kilometres northeast of the city of Edmonton. Initial production is scheduled for 2011.
Effective January 1, 2008, the EUB was replaced by the ERCB and the Alberta Utilities Commission. As notice of prehearing meeting for this matter is being issued after the coming into force of Section 80 of the Alberta Utilities Commission Act, the application will be considered by the ERCB.

Filing of Submissions Respecting the Prehearing Meeting
As indicated above, the intent of the prehearing meeting is to receive participant input on:
• the scope and purpose of the hearing, including relevant issues to be examined,
• the timing and location of the public hearing,
• the procedures to be used in the hearing,
• the participants and their roles in the hearing,
• the funding of the participants, and
• any other matters as necessary.
To the extent that parties have not already done so, the Board requests interested parties to file brief submissions outlining their positions on the above matters no later than 12:00 p.m. on Friday, March 7, 2008. To file a written submission to the prehearing meeting, please provide a copy of the complete submission to the Application Coordinator, Bob Germain, and one copy to PCOSI. Parties are advised that the Board may cancel the prehearing meeting if the submissions filed adequately address the issues identified above.
In accordance with Section 13 of the Energy Resources Conservation Board Rules of Practice, all documents filed in respect of this proceeding must be placed on the public record unless otherwise ordered by the Board, subject to the Freedom of Information and Protection of Privacy Act.
In accordance with Section 25 of the Energy Resources Conservation Board Rules of Practice, a person who intends to raise a question of constitutional law before the Board in this proceeding must give notice in accordance with Section 12 of the Administrative Procedures and Jurisdiction Act and its regulation.
